I am Mexican citizen currently living in the US, I was admitted legally (tourist visa) for six months (I-94)but I overstay. My question is; Can I apply at the Buffalo office? or due to the fact that my I-94 was for just six moths I will not have any chance? Or can I just show my US visa to prove that I came in legally?

No, as you were not admitted for 1 year, you must apply to Mexico.

interesting... and what about if i extended my six months entry to another six months? that could make one year legally in the US, or it have to be a year straight up? I still have my tourist visa till JUN09.
