Hello,

I am in a weird situation. I recently got ITA (Feb 2019) and was on H1B. However, my H1B got rfe and i am in limbo if it gets denied.

My question is if H1B get denied, can I go to Canada (on visit visa that I had applied 2 years back and valid till 2022) and continue the post ITA process or post EOR process. FYI.. I submitted all my documents and now waiting for official COPR and request for passport to stamp it.

Any help or information is greatly appreciated.

You can come to Canada - but as a visitor only. You cannot 'move' her until you have an approved COPR. When coming here as a visitor, you'll want to make sure it doesn't look like you're moving here before you have approval to do so. (i.e. make sure you have a return ticket and don't arrive with everything you own - only bring what a tourist would bring).
