I have a friend in Canada who is now the PR holder. He was married in Nepal and got divorce before he applied for PR. He has no proof of marriage like pictures or marriage certificate. But he got divorced legally. While applying for PR he wrote his marital status as single/never married. Is it in some way going to create problem for him regarding fraudulent case or deport back to his country? Any suggestion or advice for my friend? Your suggestion, advice could be of great help.
 
Yes, of course. He misrepresented, and it is considered by CIC to be a crime.

WHY did not he say that he was married? :o Does he have children in that marriage?
 
no, he does not have children, He does not have any proof of marriage, so he consider it not vital and anyway its not going to harm anyone so still is it a big issue? What does he need to do now?
 
He should have told the truth. However, he can't go back in time to change that. The odds of immigration finding about about this past marriage / divorce are very low though.

Now he cannot do anything , only hope he will not be caught.

Because I know exactly the same case when the guy got caught FIFTEEN YEARS later!!!

Neither marriage certificate nor divorce certificate were supposed to be issued? Or he just did not BOTHER to obtain them...

He can go see a lawyer to discuss his case if it makes him feel better but nothing can turn back the clock and reverse the decision he made to give false information about himself.

I would advise him to let sleeping dogs lie and not mention this situation to anybody he knows. If he gets caught, it will most likely happen because he has told somebody about this, then had a falling out with that person and they report him.
 
do you have idea what could be the consequences if he was caught and if PR card would be revoked, how can he ask for excuse?
 
If somebody found out and reported this to immigration, it is not even certain that they would investigate or do anything. However, if they would, he could lose his PR. He could appeal but if he were to lose that appeal and lose his PR, there is nothing he can do to ask forgiveness. His PR would be gone. If he qualifies, he could apply again but it may affect his application that he lied on a prior application.
 
The only other thing I see here that could cause him a problem is if he later marries outside Canada and wishes to sponsor a new spouse. He will have to provide divorce documents and such to get remarried and in the process, CIC will now know that he was married previously ... just a thought ;)
