I am inquiring on behalf of my friend's family on immigration matters. My friend had passed away recently.leaving behind a dear wife and 2 children both born oversea and have Canadian citizenship. There are 8 now & 12. However, his wife is neither a Canadian citizen nor a PR of Canada. The family wish to return to Canada but unfortunately she can only come here as visitor. The kids need to attend school and their mom have to be here. They have all the documentation to proof their legal status e.g birth certificate & marriage certificate.
Can anyone tell us what the mom legal position is or is she entitled to some form of permanency in her status(immigration wise) as she is the only guardian to the 2 Canadian kids??? Any advise is appreciated.

Sorry, she has no rights to residence in Canada. She would have to apply as either a skilled worker, or she could submit an Humanitarian and Compassionate application, but this is very difficult.

I doubt that.
Unfortunately, she has nobody in Canada why Humanitarian and Compassionate ground could apply to her. Children should stay with their parents (mom, in this case), and only when they are in their age thay can come to Canada and sponsor their mom.
