My husband (Polish) and I (Canadian) are currently living in London. We are planning to move to Quebec, where I am from, and settle there. We definitely want to apply outland, so he can carry on working and travelling (and also because it seems to be faster) and we want to start the process as soon as possible.

This means we would apply while I (as a sponsor) am not living in Canada (and provide all required documentation of intent to move). However, I do plan to relocate in Quebec a month or two after sending the application, because I want to look for a job, a flat, etc. Would that cancel our application and would we then need to start the process anew indicating that I now live in Canada (my husband would remain in the UK until he is granted PR)?

Then, if we need to start over, it might be best to wait that I am back in Quebec to fill an application. In such case, it is likely that I will not have a job in the first few weeks after my arrival. Although I appreciate that if the individual requiring the sponsorship is the spouse, the sponsor is freed from financial requirement (please correct me if I am wrong!), would it be wiser to place an application only once I have found a job in Quebec, rather than ticking the 'unemployed' box or should it not influence the process?

You can send off you application now, submit the settlement plan (intention to relocate) with your application put in it that you plan to return on such n such date a copy of your plane ticket or e-mail conformation if you have already booked your flight should be included.

You need to sign the sponsorship agreement as shown in the CIC website:


"When you agree to be a sponsor, you must sign a contract called an undertaking with the Minister of Citizenship and Immigration (or with the Ministère de l’immigration et des communautés culturelles [MICC] if you live in Québec).

The undertaking is a promise to provide financial support for your spouse or common-law partner’s basic requirements and those of his or her dependent children.

Basic requirements are:

food
clothing
utilities
personal requirements
shelter
fuel
household supplies
This also includes other health care not provided by public health, such as eye and dental care.

The undertaking ensures that these persons and their family members do not have to apply for social assistance. Its length varies according to their age and their relationship to you.

Your obligations as a sponsor begin as soon as the person you are sponsoring and, if applicable, his or her family members arrive in Canada.

Important information. The undertaking is an unconditional promise of support. For example, the granting of Canadian citizenship, divorce, separation or relationship breakdown or moving to another province does not cancel the undertaking. The undertaking also remains in effect even if your financial situation deteriorates.

Send in the application now (if you are a Canadian citizen, as I am assuming). Include your plans to go back to Canada. However, once you are back in Canada and have gotten a job, a place to live, are basically settled, then send proof of this to the visa office processing the application to be added to your file. You can only do this once the app has been transferred to the visa office abroad. Showing you have already moved back to Canada will help a lot - intent to move back to Canada is often a sticking point and the visa officers may want more info. So definitely send them proof of your move once you have done so.

Your moving back to Canada does not cancel the application. Even if your husband visited you in Canada and stayed with you during processing, that would not cancel the application.

If you do wait and apply once back in Quebec, again, I would send in the app as soon as possible. Your not having a job will not matter. Once you get a job, though, I would send in proof of this to be attached to your application.

It is best to send extra info like this to the visa office. It will just get lost or seriously delayed if you try to send it while the application is waiting in Mississauga. So once the application is in the visa office where it will be processed, you will have a file number. Send the extra info with this file number, and sponsor and applicant's names and birthdates. This will help them match up the new information with the application. (They still - very rarely - don't get it matched up.)
Any proof of your job will be fine, so a copy of the contract or a letter from the employer would be enough. Both won't hurt.
