Hi,
I am finalizing my sponsorship application for my common law partner (de facto spouse). I am Canadian, originally from Montreal, he is Kenyan and we have been living together in Kenya for 2 years. We are planning to move back to Montreal once my partner gets his permanent residency.

I am looking at the document checklist for common law partners from the Canadian side (IMM5589-E). In section 5 (Employment/Source of Income) it says: " do not complete this section if you are a Quebec resident". Since I plan to live in Quebec when I come back, do I need to give my current proof of employment/source of income abroad? Which is more important: the fact that I am from Quebec and that I want to move back there or the fact that I am abroad and working?

The sponsor does not need complete the Employment/Source of Income section if the sponsor is a Quebec resident as at the time the application was submitted..........your current proof of employment/source of income abroad should not be required........refer.....checklist.

I just read the link you posted and it says:
You are considered a Québec resident for income tax purposes as soon as you have sufficient residential ties in Québec
Residential ties in Québec include:
  • a home in Québec;
  • a spouse or de facto spouse and dependants who are moving to Québec to live with you (a dependant can be your or your spouse's child, grandchild, brother, sister, nephew, niece, father, mother, grandfather, grandmother, uncle, aunt, great-uncle or great-aunt, or your brother-in-law or sister-in-law); and
  • personal property (such as a car or furniture) and social ties in Québec.
Other residential ties that can be recognized include a Québec driver's licence, credit cards issued in Canada, bank accounts opened in Québec, and eligibility for Québec health insurance

I have not lived in Quebec for 2 years now. I don't have a home in Quebec. My spouse will move to Quebec with me IF he gets a permanent residency. My whole family is still in Quebec, but I don't have personal property there. I still have bank accounts and a credit card in Quebec, but I am not eligible for RAMQ.

I am still a bit confused. I just don't want to omit papers that would slow down our application. Thanks for your help!
