Question about Class of Application for Spouse PR

Hello,

I am a Canadian living in the US for the last 5 years, with my spouse. My spouse is an Indian passport holder and working in the US on a work visa. We have a one year old child (American citizen). My spouse has a tourist visa for Canada, but it will expire later this year; we plan on renewing this visa.

I would like to apply for his Canadian PR so that we can move back to Canada.

Which class of application am I to submit? It seems like I cannot submit via the Spouse or Common-Law Partner Class due to our current residency in the US. Is this correct?

Assuming you were born in Canada or naturalized as a Canadian before the child's birth, have you applied for their Certificate of Citizenship?

No, you can't apply inland while living in the US. You would need to apply outland.

Yes, Outland is referred to as Family Class on the application checklist.

Outland means Family Class?

You don't need to apply for that first but you should apply ASAP. Without proof of citizenship when you come to Canada, you face issues with things like getting the child provincial health coverage.
