Dear all,
Our PR case got refused due to INFANTILE AUTISM, AUTISTIC and due to the fact the immigration had asked us for addition documents from specialists that I submitted to the lawyer. But the rejection letter showing that nothing has been submitted to the immigration officer. Now the lawyer suggest to appleal the the federal court. I want to appleal the decision but I need more advice.
Looking forward to hearing from you.

Hi.
I requested to my consultant to file my application before 1 st August but he did not as i scored B1 in French and the new requirement was B2 and my application was ready with each and every document to be filed at QSW office.
Now a new disaster of 20 thousand applicants acceptance Quota.
I guess it will stay a dream to land in Canada.
Dont worry i heard all applications after Dec 2011 will fall under new rules. since your B1 take courses and get b2
easy

Hi...Yea you are right according to quebec, this is what the rule says which you stated above.
You better fill out Campbell Cohen free assessment form and once you get the response from them then talk to them over phone, stating them that you have received assessment response and you want to discuss about that then the receptionist will transfer the call to the concerned person and then discuss your chances with him. Campbell Cohen is good than the normal immigration so called "consultants."
Thanks a lot for your reply. Yes I talked to one consultant and he also told me about this clause. But I am afraid if going by this clause if I will ever be apply for any other plan. As provincial program generally ask for job offer/family relationship. I hope I can get some reply/suggestion from anyone who has actually faced issues similar to me. and also I will try to contact Mr. Cohen about this.

don't give up so easily, you're close to b2! maybe if you increase your french level you'll have a higher chance. perhaps with a little more perseverance and faith, you'll have your dream

Did the lawyer confirmed whether he had sent the additional documents? I have read other posts on this forum where autism did not prevent the family from getting their PR and another case where an appeal was made in the federal court. There was no follow up regarding the outcome thogh.
You could search for autism on this forum and read the discussions.
Where on the spectrum is your child? Did you tell the doctor or they detected it? Please keep us posted.
Read in another forum ... for the comfort of ppl like me who have already sent the file and yet to get AoR .. .. For sure the file will be processed under new rule irrespective of the date you have filed (provided if it is still pending for preliminary evaluation). Just my thought ..
WARNING: The 20K cap will be counted taking into account not only the applications filed on or after August the 1st 2013, but also those filed prior to this date, for which the MICC has not yet started the actual processing (i.e. they haven’t reached the stage of “preliminary examination”). This retroactive application of immigration rules is a “first” when it comes to the Quebec procedures, and will affect perhaps hundreds if not thousands of applications filed over the last few months.

May be you could call to Montreal office to make sure that your lawyer indeed filed the additional documents. They will check and inform you if they received the documents.
