Hi,

My parents immigrated from India to Canada in March 2010 and stayed till October 2010 and went back to India. (March 2010 - October 2010)
They came to Canada again in October 2013 stayed till July 2015.
In March 2015 they met the 2yrs out of 5yrs requirement and applied for the 'PR card renewal'. After that they stayed till July 2015 and left to India.

In April 2016, I received my dad's card, and they sent a mail for my mom to come and pick up the card. I went to their office and asked them how she can come and pick up the card in Canada as she is in India. He said that she should apply for 'Permanent Resident Travel document' to come to Canada to pick up the card.

Here are my questions:
1. From March 2010 - March 2015 they met the requirements and applied for PR card renewal;
Going back 5 yrs from 2016 (as of now, 2011 to 2016) my mother (and father) are missing 3 months from their residency obligations.
They sent the PR card home for my father.
For my mother to apply for 'Permanent Resident Travel document' she is missing 3 months from residency obligation. So she needs to send an explanation under 'Humanitarian and Compassionate Grounds'.

My parents have only 2 children and we both are here in Canada. And their only grandchild is in Canada. The reason they rushed to go back is my State in India is divided into 2 states. They wanted to make sure their ancestral house is not taken by any forces in India.

Did any one come across this situation as 'Humanitarian and Compassionate Grounds' where they didn't meet their residency and their PR card expired?

2. In India how long is the process to get the 'Permanent Resident Travel Document'?

Tell them to get a US visa and fly to the US directly. You can pick them up in the States and drive to the Canadian border.

Don't even try to apply the PRTD if one of them don't meet RO, otherwise they might have to appeal in order to keep their permanent resident status.
 
Around 2 weeks through VFS India for the normal case.
 
Personal view but do not think Human and compassionate grounds will work as parents didnt through their own choice/actions meet the residency requirement where the rules are clear, whereas H and C generally tends to be more aimed at refugees or unaccompanied minors but not reuniting PRs with adult children due to a failure to follow the residency rules. Maybe the US land border is the best option but that does assume they can get a US visa given a travel document requires proof of residence in Canada among other things.

It's not a case of H & C unfortunately. Your mother will risk losing the PR if she applies for PRTD. So do not even think about it.
The only possible solution is for her to get a US visa and come there. And you go to pick her with her PR card in US.
