hello friends .. i am getting married on 21st april in India to a canadian PR.
Planning to apply PR(outland) to me after our marriage.
I already raised few queries regarding flying with my husband immediately after marriage on visit visa and got very helpful answers from lot of helping hearts.
I have few other queries now.
-> Can i apply for Open workpermit now so that i can start working in canada till i get my PR??
-> Will there be any delay in PR processing if i stay and work in canada under Open Workpermit??
-> Which one is advisable for me to stay with my husband in canada after mrg?? Visitor Visa or Open work permit?? Also how about the chances of delay in parallel PR processing(outland i.e New Delhi)
-> Is it possible to apply Outland PR @ Buffalo Office to me being an Indian Citizen and never been to U.S?? We have plans to do so because we heared that PR Processing @ buffalo office is pretty fast when comparing with other offices.
These are some personal opinions regarding your queries:
-> Can i apply for Open workpermit now so that i can start working in canada till i get my PR??
-> Will there be any delay in PR processing if i stay and work in canada under Open Workpermit??
Answer-> In order to apply for OWP as a PR applicant, the application for PR has to be filed using In-land process from within Canada. Even that way, you will qualify to get OWP only after "first stage approval" which may take 6 months.
-> Which one is advisable for me to stay with my husband in canada after mrg?? Visitor Visa or Open work permit?? Also how about the chances of delay in parallel PR processing (outland i.e New Delhi)
Answer-> I do not know anyone who has done parallel PR processing using both outland and inland process. I don't know if you are allowed to do like that. From what I know Outland processing is much faster than In-land Processing. You could check the current processing times in the CIC website. If you do not like to stay in Canada without work permit, then I think it is better to come to Canada only after you get your PR via outland processing.
-> Is it possible to apply Outland PR @ Buffalo Office to me being an Indian Citizen and never been to U.S?? We have plans to do so because we heared that PR Processing @ buffalo office is pretty fast when comparing with other offices.
Answer-> In order to apply from Buffalo (USA), you have to be legally admitted to US for at least one year. If you have not been admitted to US, then I don't think you can apply in Buffalo.
You are not eligible for an open work permit. You can apply for a TRV but you may be denied if they consider you a risk of overstaying.
You can apply through Buffalo only if you have been admitted to Canada or the US with at least a one year visa. That is if you were on a regular work or study permit in Canada, you could. However, outland processing in India is faster than in Buffalo, see http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp#asia
Your husband as a PR, must be in Canada to sponsor you.
If you don't get the TRV to go with your husband to Canada, you will have to apply outland through New Delhi and wait until you get your PR. Processing time is a month in Mississauga to approve sponsor plus processing time of New Delhi, currently average 3 months.
If you get a TRV to go with your husband to Canada, you have a choice of applying inland in Canada (work permit in about 6 months and PR in 12-18 months if all goes well) or you can apply outland through New Delhi if you prefer that.
