Hi guys,

I have a question. My wife and I have been in Canada for 5 years now. We recently got our PR through Canadian Experience Class. She was the primary applicant working as a manager at a hotel. We have been together since we came to Canada from India. We got married 2 years ago.

Unfortunately, things are not going well between us, and as much as I hate to admit it, it seems that she wants to divorce me.

I was her secondary applicant and got my PR just because she was my wife and completed 12 months of CEC so I got my PR being her husband. Nothing was fake, we have come a long way together but for the reasons I am not gonna mention, since I am ashamed of myself, she is most likely divorcing me soon.

Do I lose my PR? I know that people who got their PR by Family Sponsorship lose it if they haven't lived together for 2 years after being sponsored.

Does this apply to CEC as well?

No - you won't lose your PR.

The rule you have mentioned only applies to those who were sponsored as spouses through Family Class.

Thank you so much! Is it 100%, on top of everything else that is going on in my life, PR is the least of my worries, but if I could just get at least the fear of going back home off my chest, that would make things a little bit easier...

Sorry to hear about that, divorce is never good news...

As far as I know, and this is only my belief, only those who were SPONSORED lose their PR if they haven't lived with the sponsor for 2 years. I don't think you will lose your PR, but this is only my belief, I am not 100% sure... Seniors correct me if I am wrong.

Ok so I am also looking at my COPR now:


Where it says Conditions: - there is nothing at all just empty space (so no condition 51)

Where it says Sponsor Information: It says N/A

Does it mean I am safe?
 
Again, conditional PR does not apply to CEC. Only to spousal sponsorship.

If you want further proof, head over to the official CIC web site and search for "conditional PR".
