You always have to make sure while your inland application is in progress,the principal applicant is living here legally. I applied this year and my wife has work permit till next year september, if im not getting enough update by june , i am going to ask for a visitor extension. if you haven't got a AIP (agreement in principal) and your applicant has expired status, they ll cancel and you have to apply as outland. It happened to a friend of mine, his wife had to go to Brazil and apply from there.

I sponsored my wife Inland. applied on Jan 24th 2019 without the application for OWP as she came to Canada on work permit after marriage and that was valid until dec 22, 2019. Received additional proof of cohab request in May and no updates after that.
But then we panicked and applied for OWP online on November 23 2019 as there were no updates on PR.

Last week we called IRCC to confirm the OWP application. But they said we should have sent it in mail and not online.
Only the PR applicants who have AIP should have applied online. She is out of status now and legally on implied status until a decision in made on that OWP(May be it will be rejected in February when they review).
Currently we are thinking to apply for status restoration and OWP by mail but it will take 4 months to process.

I just read your messages on this thread. I don't know if we should go ahead and first apply visitor visa to restore status so it doesn't hamper the PR process or just wait for the decision on the first(online) + second(paper based) work permit that we will get after 4 months and we attach the AOR of this with the PR application. Really confused and worried.
Can you pls suggest?

tought situation, im waiting for my AOR currently, i applied December 6th(received date) 2019, and waiting for AOR currently. My wife's work permit is good till September 30,2020. so in my case i thought i would get the AIP by then, that's why i didnt apply for the OWP, but i do understand in your situation its little different.

don't count my opinion as legal but you have 2 choices.
1-if you get the decision while on implied status, ur good to go and this is best case scenario.
2-it gets returned (application due to payment, missing docs, something else missing) your spouse automatically will be out of status, i think at that point you will have to apply as outland, and most likely your wife needs to return immediately(i think once you get your deny you need to leave immediately.

i mean its a shoot in the dark but still apply for visitor , it might not even be processed while you got your decision, but i think you should ask for an update on your file through their online system, sometimes they request docs and never work on the app again, i have seen people requesting electronic submission and then suddenly someone makes a decision(most likely they forgot your file and then when u inqiure about it , they realized it has been lying on their desk for so long)

i know i dont have definite info but, i would immediately ask for a info request through the system, apply for visitor in the mean time.(worse case u ll lose 100 bucks) , and hope they give you an decision (a good one)

Thanks. from the date of expired status we get 90 days legally to apply for restoration of status as a visitor (200) or worker(355). we will try to get in touch with IRCC and do what is suggested as best. Once again appreciate your quick response. And good luck with your process

We were told to write an explanation to the officer and wait to obtain the decision of the current work permit application. We did and are waiting now. Also moved through MP and they confirmed they received the application at Edmonton. dont know what will happen. we should hear anytime.

hopefully everything works out good, i still have 7 months till my wife's PGWP ends, but if there is no indication of the AIP i think i ll apply in 2-3 months for the OWP

Please apply like 100 days before for safety. And also call them like one month after applying to make sure everything is good. we didnt do these things hope you do. I wish your spouse gets PR before. just in case.
