help...tourist visa refused...dual intent.

my common law partner applied for a tourist visa to come visit me in Canada, from Mexico.

It seems as if Immigration wanted proof of relationship..............we don't have bank accounts together or own any land together.
So, stupid me, I put in my invitation letter that we would marry when she comes to Canada to visit......

Then they used that against her...........Said she was coming to Canada with Dual Intent...to visit and get married to a Canadian.

now..............that this is on file...............

How to get a tourist visa .............send another invitation letter stating we will not marry?

I don't understand.............I thought it was mandate of immigration to bring families together?

Please advise.........

Visitor visas are for people who want to visit Canada short term - not for those who have plans to live here. Yes - CIC has a mandate to bring families together - but this is through PR applications (not visitor visas). It's not surprising the visa was refused. By stating you were going to marry your girlfriend in the invitation letter, it made it seem like she was using a tourist visa to come to Canada and then try to remain here long term.

If you want to reapply - you need to focus on proving that has has strong ties to her home country (e.g. employment, property, assets) and has no plans on remaining in Canada long term. It was not important to include proof of your relationship in the visitor visa application. It was important to provide proof of her ties to her home country.

She has no property, but lives with her parents.
her name is on the lease.
she can only provide .
lease agreement
letter from work, stating 2 week holiday
bank account statements
2 credit card statements


Should I include a note stating we will not marry?

No - I would not include a note saying that you won't marry. This will look very suspicious.

It's not mandatory for the application. But it is mandatory if she gets the visa and comes for a visit.

Questions like yours get asked very often so people don't always respond because there's already plenty of information on the forum. If you want more information, you'll have to do some research on your own by reading through the old discussions in the Visitors section of the forum.
