90 days will be end of Feb, I want to file restoration before 90 days and ask them to restore status until HC decision is made. They never violated immigration law and I dont want them to overstay. Mom’s status expired October 2024, received visitor record refusal. So I want to use 90 day rule and try to restore status. I know it will be extremely difficult.
Im just worried that if they leave they might not be able to get another 10 year super visa because they filed HC. So if they leave that would be it… at the same time I dont want them to stay here illegally as Ive put so much effort and $$ to maintain their status past 10 years.

Apply for restoration they have nothing to lose. If approved I would not count on being able to extend their visitor status until the results of their H&C especially a 2nd H&C. You can certainly try but would also be realistic and have a plan b.
 
IRCC hasn’t updated the processing time for this week. Hope they won’t add more like they did for spousal applications.

Processing time is just an estimated average. Some will take longer some will be processed faster. Would take processing times with a grain of salt.

The processing time starts the day they receive the complete application and ends when they make a decision. It may vary depending on how many applications they get or if the application is complex.

Most of our processing times are historical. This means we base them on how long it took to process 80% of applications in the past.

This means they use mode instead of taking average. When you take out outliers, 21 months what most cases take to complete. (If this numbers are correct)

That still doesn’t mean anything for people looking at posted processing times. We have seen that most 1st applications are being processed around the 22 month period if not a little longer at this point so people should expect processing around that time period. Also IRCC is known to post processing times that are not correct.

what is the easiest way to switch from visitor visa to grant Federal PR. either through out Asylum path or Humanitarian cases ?
will wait for most valuable members !

Neither is easy. Both take a long time and require the applicant to prove their case.
 
Actually our lawyer is recommended to claim for Asylum seeker to be able to extend our status here in Canada but since he is asking for a huge down payment I’m little concerned.

Do you have a genuine and strong claim supported by evidence? What about IFA?

So then it sounds like a refugee claim is a really bad idea.

Sadly many consultants and lawyers are giving bad advice for profit. Filing an asylum claim without any basis can have serious longterm negative implication for you and your family not only in Canada but in countries that share information with Canada.
 
Any update from July, August , Sep applications with AIP for portal email yet? I got nothing so far after address confirmation request on Oct 30th, the wait makes me worry too much
