Hello, I wanted to know my husband’s father isn’t well. And we are on visitor visa and applied for h&c for well being of children. My husband wants to visit his father back home. Would it affect his application or entry upon return? We applied 2 months ago so only have AOR

The exact impact on the H&C application and re-entry is hard to guess as its eventually a discretionary decision of the IRCC/CBSA officer. There is always risk that Officer may deny entry to Canada if Officer is not satisfied for any reason and being on visit visa the risk is higher. Having H&C application itself does not make any one inadmissible to enter Canada. If you have any argument in your H&C application that contradicts or weaken if your husband visit home country, so it may negatively impact H&C application so it depends on the argument and your unique H&C case. Again there is no rule and its Officer discretion at the end.

It might cause problem for him to enter canada, the cbsa officers might stop him at the port of entry and he might be returned as canada has become more strict on people entering the country on a visitor permit/study permit/work permit and by submitting a H snd C application you/your husband already showed the interest to stay here permanently which is a red flag for the CBSA officers, and the H and C application almost automatically becomes invalid/weaker if the applicant leaves the country, however there is exceptions to this rule,so I would say consult with your lawyer, explain the situation to your lawyer and do what the lawyer suggests, good luck.

Hi,

No one can say what will happen.

- Husband arrived temporarily to join an application for an H&C waiver to have PR assessed in Canada and then remain as a permanent resident
- then he left temporarily

- he intends to return on a temporary resident visa to remain permanently in Canada

- he/they cannot work, or study so he'll be entering Canada to join the family who will be authorized do nothing for an indeterminate number of years, awaiting the first stage decision. Along the way the family's temporary status will be refused further extensions and the foreign nationals told to leave Canada in order to avoid enforcement.

I suppose that he might be off-loaded on the return, or examined and detained at the POE and be put on a return flight to _______________, or he could return unchecked to visit for as long as the status lasts.

What happens then? You don't know.

The H&C - the year it's assessed: 2027, or so - I don't see this being the largest issue over the intervening years.

Being in Canada without authorization is much more likely to become a matter of concern for whoever is still here.

There's a chance he may not be able to reenter Canada.

If he leaves, there's a decent chance he will not be allowed to travel back to Canada. So you need to be prepared for the possibility that you may be separated for a few years.

Hi everyone,
I really need help and advice for my parents visa.
My parents are in late 60s and we are 2 sisters. My sister is married in india and I am in Canada PR from last 5 years. My father is paralyzed, cant walk on his own and my mother is sole care taker. I want to bring them here so that I can take care of them. Supervisa is in process from last one year due to military background.
Can H&C category be used for applying their PR?
My sister is not able to help them as she is not physically very strong.

H&C has a low likelihood of succeeding since your sister lives in your home county. However you can certainly apply.

Note that they need to be in Canada to apply.

Supervisa also may be denied based on paralysis alone. Also may be impossible to get supervisa insurance or prohibitively expensive.

As people have already noticed H&C processing times have gotten longer and due to the high volume of applications and attempts to reduce temporary residents and PRs this will continue. Will also likely get harder to get approved. Reforms to the program are needed because it has become a catch all for everyone who doesn’t qualify for other programs which was not it’s intended purpose. Was also not meant to process this volume of applications. Think people need to be prepared for a new reality. Also assume quota for this year has been meant which is why many with AIP have not received eCOPR.
