I am Canadian and my boyfriend is Romanian. I am sponsoring him through family class. Which one of us fills out the IMM5409- Statutory Declaration of Common Law Union?
You don't require IMM5409. It is only for applications where the common-law partner is a co-signer, which isn't possible when the partner is the person being sponsored.

Unless your boyfriend is a co-signer (which he can't be), you don't need to submit that form. Some have still opted to do so, in the hopes that it helps with their evidence of relationship, but as you will see on the document checklist, it's not required.
If you do fill it out, you would both need to sign it and it wouldn't matter which one of you filled it out.

CIC does sometimes request it even when the co-signer situation doesn't apply. You will need to send it in. Either of you can fill it out but both of you need to sign it in the presence of the notary public/commissioner of oaths.
