I applied for refugee status in 2004 and it was refused in 2005. After that, my PRRA and H&C got refused and I appealed in the Federal court against the decisions and both the appeals were declined by the court. I was notified to leave Canada by CBSA and I left Canada within 30 days after the notification date and paid my own ticket to return to my home country. Now, if I want to return to Canada again, do I need to apply for an ARC??? I tried to find it from CIC website , but still not sure about this. It's been more than one year that I left Canada. Can anyone please clarify me whether I will require an ARC or not????
Hello Rock : Yes you have to apply for an ARC... Depending on why you want to go back to Canada you will have to fill a form and pay $400 fee. If you paid your tickets and had no background problems that´s it, but you have to check out the CIC website inadmissibility section to determine the exact procedure in your specific case. Master7 : I have just found out that my application for refuge became a deportation order since I never showed up to the hearing and then they issued a removal order that ended up in deportation order. Without having a clue in 2007 I asked an immigration lawyer about my intentions of applying as a FSW and he told me that I could do it and I did it. Now after 5 years (normal for the famous 2007 FSW backlog) my lawyer asked me for proofs related to my departure in 1996 without receiving any removal or decision. I have already submitted my passports and a pile of other proofs that confirms my departure in 1996. My lawyer told me that my FSW application was approved (We had our medicals in June 2011) but now we need the ARC, because in this case the procedure is FSW approval and then deal with the ARC if you have not backgrounds problems (criminal,etc)...
