We are Thinking that maybe an Immigration Lawyer will be best! As for me moving to Libya , He is against me going there bc of my safety , But Im willing to take my chances, Fear of being without him , out weighs any fears I have about my safety In Libya :'(
It might be a good idea to live with him for a while before you apply. CIC will assess the nature of your relationship. as others have said, you have a few red flags that you will need to address (again - I'm not saying that your relationship is not genuine, etc, I'm trying to give you elements to prepare better). If you read the forms for the sponsorship (and I suppose that if you have done it for your first husband you are familiar with them already), you will see that you will need to prove to CIC that you are in a genuine relationship. Because of the previous sponsorship, CIC will be extra cautious about this one. Also - you can not sponsor another person before 5 years. which in your case should be almost OK. so - if you go and live in Libya, you can get married there (once the divorce is done), and get more proofs about your current relationship - it will make the process much easier. You will need to prove more than the "normal couple" as it's the second time you sponsor somebody. Make sure you keep proofs of your relationship, emails, phone, etc. And weigh your options and see if living in Libya for 6 or 9 months with him ( not sure you can do that before being married given the social context in Libya) would be an option - it would certainly make your case stronger (2 weeks together might not be enough to convince CIC).
Your situation is a bit tricky, but not impossible.

Well The sponsership of my first husband was never sent in , seeing he got arrested at the border and had to apply for a pardon , he was given a three year perament residency card , but the sponsership forms were never filled out, And as far as I HAVE READ i though it was on people that was sponsered in here that could not sponswer anyone elese for 5 years ? Looks like ill be living in Libya for a while .... But does that apply to me seeing the forms were never filed ?
How did he get a 3 year PR card? Do you mean ban from Canada? Visitor's visa?
If the forms were never filed, then it technically never happened. Did you suport him for a visitor's visa? That would link back to you, but not in the form of spousal PR sponsorship.
No I diddnt sponser him for any kind of visa . I went to USA got married there stayed for ayear. he cancelled my forms and sent me and my 9 year old son home without reason , just that he was scared ... I was home for about a month he decided to drive down and got stopped at the boarder they seen a bunch of things in his jeep and seen that he was trying to come to canada to stay . and he went trhough the border anyways and got arrested . they gave him a month to come see me and in that month we had a small interview with CIC. and they gave him a three year PR which he had tow ait three years to apply for a pardon . then needed a extension on that bc of the wait time it was taking to get fingerprints from FBI. the sponser ship was never files and he was given a temp Pr and a open work permit .. Then things fell apart and he left in Dec of 2012
I really dont know how he got the PR card , we were called in for an Interview , they told him he should have not been given the month to ome into Canada to even see me , but seeing he was given that , they issued him a 3 year temp PR and a open work permit . bc he had to wait 3 years before he could apply for the pardon .
Really dont know wat to do ... We just want the fastest way and the easiest way for him to come here with me .. He has A BIG FAMILY HERE THAT CANT WAIT TO MEET HIM iNCLUDING 2 BEAUTIFUL GRANDDAUGHTERS ,wHICH BY THE WAY ARE NOT THE KIDS OF MY FORMER HUSBAND ,they are my Children
