Hi, I was just wondering if you've landed. I was just going through your post and found it interesting as I am also going through ARC process for my hubby who was deported...

They asked us for just the fee so far,,, would the PPR letter be the next thing???

How did the process go for you? or are you still waiting..

Your reply would be much appreciated.. thanks!

sincerely,

One q guys !!

We send our application of sponership long time ago, but we did not send ARC yet ( the letter) because our lawyer said not now, should we send it now or what ?

hi der,
same thin happens with me as i also submitt my spouse application and my lawyer said i have wait till they told me 2 apply for ARC or immigration people gonna send da application for ARC themselves....

I want to go to Canada for a brief weekend visit. The Canadian Consulate in NY told me i had to get an ARC because i was deported from Canada when my refugee claim was denied. Thank God, my refugee claim was approved in America :D and i have a green card. From reading all the blogs etc, i have come to the conclusion that its pretty tough for me to able to get an ARC since i don't have an underlying family sponsorship application or work application. Does anyone know of any instances when an ARC was granted to a green card holder? I have had no criminal record in Canada or America. Ban for life from Canada is pretty harsh a punishment for denial of a refugee claim i think and all this happened when i was still a minor, 17 years old.

Hi,
Does anyone know , when and how we have to pay the removal expenses after the application was approved and the interview was done (positive)???. Do we have to wait until cic asks for it?? Thank you

went to Canada as a student and completed one year of studies and did not finished the other year due to financial reasons. Since my time in Canada applied for refugee and Humanitarian and both got denied :(. however, during my time i was working and volunteering as well, but, did not submit all the info for my humanitarian case. Got a removal order that turn from a departure into a deportation order because they end up paying for my ticket cause of wrong advice :(. however, do not have a criminal record and left Canada on he date that was given to me. During my removal i was still currently employed as Sales Consultant a d got a "Letter of arrangement of Employment" my boss wrote a letter for me as well asking for ARC to return and work and explain why base on skills etc. i been working with the company for over year less than 2 and was working when issued the removal order I have in possession Moms mental records from since my birth, my job contract, a working visa that i paid for when was working in Canada and expires end of this year. i followed all CIC rules as well and they note me as not being a danger to society all good stuff on the departure sheet. But CBSA says i have to ask for a ARC so i can come back and work and someone told me its only because i let them pay for my ticket that's why i have to ask for ARC! what are my chances of getting the ARC? Thank you!

hi everyone,

i would need some information, because i got confused now seriously. i do not know whats the truth. I would like to go back to canada!!!
about for a month i was remove from canada and we received than a ''Departure Order'', cause my refugee claim wasnt success. at the CBSA i did ask the officer, if we have another chance to get back to canada. she said we must apply for the ARC without that we have no chance back to canada. Now there is several things what i dont really dont understand.

1) CIC says: 1. Departure Order (form number IMM 5238)

a) If you received a Departure Order and

left Canada within the required 30 days and
verified your departure with a Canadian immigration officer at the port of exit

you do not need an ARC. You may return to Canada subject to normal examination at the port of entry.

Officer said we need the ARC!!!

2) On our ''Certificate of Departure'' section B says: Cause of removal: A36

Why??? I do not know exactly but A36 means something about crime. We did follow all the instructions and all the procedure of our removal.
Just our ticket was paid by CIC.

3) On the ''Departure Order'' stand these: Paragraph 41(A); 20(1)(A), Paragraph section R6

Can anybody help me to find out what am i suppose to do? sould i apply for ARC? or i can go back based on what the CIC says on their webpage, that by Departure Order man dont need an ARC?

Thanks

We were in the same situation and unfortunatly there was a few people from my thread that went through the arc process as well.
we were all denied refugee and got a departure order.
But even with a departure, if you were a refugee and denied they will still ask you for an arc, garanteed! It happened to us and many others.

I dont know what the A36 means either, but either way u still have to get the arc and since cic paid for your ticket you have to pay them back the 1500 before you can return to canada.

Are you going a spousal sponsorship ?

or do you just want the arc to go back to canada.
because unfortunatly if you just want to the arc to go back to canada it is incredibly hard to get.

on the other hand if you have filed a spousal sponsorship, they will automatically ask u for the arc at the end of the process, and its most always approved under spousal sponsorship.

feel free to send me a PM if u need more answers :)

Dear LeisaP,

Unfortunately i cannot going on a spousal sponsonrship. Me, my spouse and my kid are all been removed from Canada.
I just want a simple(?) ARC to back to Canada. This fact makes me down that is so hard to get an ARC even if man did everything right there. Piad taxes, worked hard, built a small church there... :'( I have no idea how can i back to my favorit country ever.

Whenever CIC insists on paying for anything or offer you anything, make sure to always get all that kind of information written on paper as proof if you later feel that you were misrepresented. CIC are never consistent and each person says something different. If anyone on here should know what your going through it would be me, I have been through hell and back with immigration due to my husband.

My husband applied for Refugee protection back in 2006 and was refused in 2009, he was given the right to appeal it however his lawyer did not bring to his attention that he recieved a departure order which gives him 30 days to leave Canada willingly and return to Canada with no problems, nor did he inform my husband that once they appeal the refused refugee claim, that the departure order gets put on hold until a decision on the appeal is made. Basically my husband was misrepresented by his lawyer which later resulted into a deportation order he did not come to know about until the day he received a letter in the mail giving him the right to apply for PRRA. With that being said, his PRRA of course was refused and he was deported back in september of 2012.

However, I had submitted an outside application for sponsorship before the deportation and I decided to come to Israel with my husband until he can return to Canada because we do have a child together and I wouldn't want him to be apart from his child. I can tell you that they have recently requested that I pay the PR fees and the ARC fee in order for them to finish processing the sponsorship application along with a new Police certificate and both decisions for both applications will be made at the same time. Pretty much the Canadian Embassy official told me that all we have to do is pay the fees and all will go as planned STRAIGHT UP this is what they told me its all about the money and the day of my husbands interview the lady told me the application will be approved and that she believes our marriage is genuine. So far so good and my husband should be able to return to Canada with me in a matter of a month or 2.

ARC are only very hard to get if you do not have a valid reason or as they say a "compelling reason" such as a bonfide marriage.

My application is most likely to be approved because my husband and I have a genuine marriage, when he was asked to leave he left, he paid he's way back, no criminal record, he didn't need an escorts out, he wasn't detained for any reason, does not owe the government any money and on his deportation forms the CBSA officer quoted that my husband "DOES NOT POSE A THREAT OR RISK TO PUBLIC"

When you go to apply for the ARC you have to attach all the documents your husband received for his deportation as proof that he left when he was given a deportation otherwise that will come against him when applying. The CBSA officer said MAKE SURE MAKE SURE u get every copy and submit it with the ARC as proof that my husband did obey by the law.

If you have any other questions feel free to ask I am telling you I went through it all and still not done, I pretty much know everything about the system and how it works.

anyway good luck and I hope this helps

Dear friends,
I have been recently charged of misrepresentation and banned to enter canada for 2 years. May you please advise me how can i get the ARC as I want my spouse currently living in Canada as PR sponsor me under Family sponsorship category. I am desperately in need of your suggestions.

An ARC won't help you and doesn't apply to your situation.

You'll either need to wait out the misrepresentation ban for 2 years outside of Canada and then have your wife apply to sponsor you. Or hire a good immigration lawyer to try to get the misrepresentation ban reversed.
