Not sure what is the background of your employment terms & conditions.

From the letter, you posted. CIC is asking a letter from your employer, that , your employer do not have any objection on your PR appliation.

i work in a closed work permit as a permanent employee for the same employer (sep2009 to till date), many of my friends who work in the same company didnot get this step and got PR successfully under CEC category

I can think of a couple of reasons why they may ask this -

One - did you come here as an intra-company transfer? In those situations, the employer typically pays moving expenses and other benefits (e.g. housing), in exchange for the agreed-upon term of work. If that term is violated (e.g. employee quits), then the employee may have to pay back some of those expenses - CIC wants to be sure you do not incur a debt.

Two - even if it is not an intra-company transfer, did you include a copy of your employment contract? If so, were there any similar terms that CIC should be concerned about? Did your employer finance your move to Canada?

Three - If your employer is not a private company but a quasi-official organization, and you owe some return-of-service?

Only you know if there was some type of agreement with your employer that CIC is concerned about. BTW - Just because your co-workers escaped this scrutiny does not mean they should have, or that the next applicant will.

If none of this applies or you still can't think of any reason why CIC would be concerned, you can:
1) Contact them and ask for clarification - it is possible there was some mistake.
2) Just do it. If your employer is supportive, just ask for this letter and submit it.

i work in intra-company transfer in a closed work permit, i have sent the employment contract ( overseas deputation agreement document) to CPP-Ottawa today, eagerly waiting for the reply from CIC.

Hmm... why did you send them that? That is not what they requested...

That is what requested in my case too and even I am thinking to sending that Overseas deputation Agreement document which states the agreement between me and my employer when I am onsite.

Please share your results once you have received an update. As the other sr member mentioned to NOT to send that, I would be waiting for your update before I proceed with sending the same in my case.

Mine is also an Intra-Company transfer and closed WP. However, i have no financial obligations If I receive my PR. Can I also mention them all these facts?

Please advise

Hello cecapp369, rambo2011,

This type of document/declaration request seems to be something totally new demand from CIC.

I searched both Canada Visa and Trackitt forums to find any similar cases, but there are none.
I have seen doc requests reference letters or job description letters or tax (T4) etc being asked for, but nothing like this.
Looks like they have recently changed some rules or added some additional docs of this nature.

Can you please specify from your eCAS status, when exactly they started processing your application?

Looks like it is a new demand.

Also, check from your company Intranet Site, like, if you can disclose "Overseas deputation Agreement document" to anyone or not.

Because, sometimes CIC will do background verification with employer.

I didn't say you SHOULDN'T send the agreement, I simply said that is not what CIC requested. They want a letter from your employer, with a current date, stating that there are no financial or other obligations. There is a world of difference between that and an original employment agreement.

If you don't give them what they ask for, or at least demonstrate your efforts to get it, chances are your application will be rejected.

Hi Rambo,

I have a msg from in my inbox, but not sure how to reply that. Thats why I am posting the reply here for your question

hi,

did you get any reply from CEC ? did they accept your explanation?
I haven't send the requested document yet ( No fin obligation letter). I am actually waiting to hear from you on your status as you have already sent the deputation letter. Please share your results with me when you get an update.

Thanks

Hi Rambo,

I am planning to send the letter mentioned below for their query on "No financial obligation letter from Employer"... please share your thoughts...

Dear Sir,

In regards to the query that I have received on Dec 17th, pertaining to my Permanent Residency Application number XXXX, I would like to inform you that So and So Ltd do not provide any support for their employees in filing for their Permanent Residence and from seeking immigration. However, SO AND SO Ltd do not hold any employee financially and legally liable in case he/she applies and obtains immigration from Canada. In support of the above mentioned, I have attached a Deputation Agreement signed between I and SO AND SO Ltd which governs my employment, visa status and terms & conditions in Canada. Herein the agreement, SO AND SO has never mentioned any objection for an employee applying for immigration. Hence, my current employer is legally/financially not objectionable if I obtain a Permanent Residence. I request you to kindly consider my request and further process my application. Should you have any questions then please feel free to contact me.

Does this sound OK?

i still didnot get any update from CIC when i submitted the ODA agreement document, waiting for reply from CIC. You can send this mail and wait for the reply from cic.

Hi Rambo2011,

Let me know if you receive any reply from them for the deputation agreement. I haven't sent yet as I would like to proceed based on the response you will receive. As I have another 15 more days to send this, I will be waiting for your reply.

Thank you,
CECAPP369

This is the reply from CIC for sending the ODA (contracts), since my company cannot provide the requested document.

We will consider the information you have provided along with the fact that you are unable to provide us with the document we have requested of you, and we will advise you shortly as to our decision. I should point out to you that failure to comply with our requests may result in the refusal of your application.
