Thanks, South America. If you apply for the Pre removal risk assessment you kind off have a legal “status” that’s the main goal so you can apply for the sponsorship application. My personal opinion is to contact a good legit migration lawyer.

His visa is still valid, there's no stamp on his passport upon entry. From what I know, he is legally allowed to stay for 6 months. He did not apply for any renewal after.
Moving forward, should I start with the spousal sponsorship inland and apply for his permanent residency as well?
So his visa would've expired December 2019. Its too late for restoration and he is now out of status but you should go ahead and submit your application. He can be out of status and still apply apparently.

Just to clarify it wasn't removed it is only on hold until you get the results of the PPRA. The fact that covid has paused many removals and slowed a lot of processing has also likely helped.
