I only want to sponsor my mom with my 18 y/o sister. My dad abandoned us 15 years ago, moved to a different country and now has a new wife. Mom and dad are not divorced yet. My question is do i still have to count my dad as a dependent? If i count him my income will be insufficient for 2016. Is there any way to exclude him from the count? I’m not planning to sponsor him now or in the future. Is it okay if I don't put him in the dependant section of the forms? Would a letter explaining the situation be enough to satisfy the immigration officer? For my mom’s marital status, should I put Legally Separated? But I’m worried because they don’t have court documents to support that. I'm so worried it might get rejected if he's not included in family size. I'm so stressed!

Hi I have almost the same situation as you. My parents are not divorced, but he left us 20 years ago. I decided to get an affidavit made where my mom indicates what happened. Affidavit's are legally binding even though there is no legal separation. Also, I have indicated them as legally separated in the forms and have not included him as a dependent. Lastly, we have prepared an explanation letter explaining the situation and my mom makes a solemn declaration at the end that she will never apply for PR for my father at any point in the future.
I did a lot of research in the past few years to understand the meaning behind adding spouse as dependent even if they are not accompanying you. My understanding is that IRCC requires it, and all the background checks and medicals because if they didn't, one of your parent who receive's PR may call their spouse to Canada through spousal sponsorship which does not have such hurdles as parent sponsorship. Basically, a spouse, may slip through the system even if some requirements are not satisfied, for example, they may be a burden on the healthcare system. Therefore, declaring that your parent will never sponsor their spouse should suffice along with affidavit.
If possible, have your parents go to the government office in their country and get a document confirming they are legally married. While a marriage affidavit has worked for me in the past, i have also had push back from IRCC from them as they would like something official from the government in country of marriage.
we can have marriage certificate from govt. office (shouldn't be a problem) but it will be issued with current date. not sure would it be a problem ?
(marriage date on it will be of 1960s)

In the Interest to sponsor application I wrote both my father and mother family name with extra space in the middle
example if we assume the family name is Alesm
I wrote it as Al Esm
Thats because my name here in Canad is written with Space in the middle
But now found out their name in their new passports is written without the space Alesm
I can add Affidavit for this with explanation but signing the Affidavit with real public notary is huge hassle where they live.

I am also in a similar situation but my mom did get "Legally Separated" back in 1973 and we have the documentation. Apparently in Brazil there is such a thing as being divorced or legally separated though I don't know the ins and outs of it so I am tempted to add a letter like you did.

The issue date of the certificate should not be an issue so long as the date of marriage is confirmed in the 1960s. I would mention it in the submission letter also that the original marriage certificate was lost and that you obtained a new one from the government office. I would also submit the original document.

anyone know if they will let us know if our application is complete and accepted before the deadline of 28 June? It is so scary that AOR is sent after more than 2 months because if anything is wrong we lose the chance to resubmit!
The AOR is the make or break part. They send back your returned docs or AOR after the 60day deadline. So either you receive your documents back or you receive an AOR.

Someone said they will start processing immediately once they receive an application, hinting an application should be returned once determined incomplete. This could take less than 60 days.
But with your suggestion, it sounds like they will only start processing everyone after June 28.
Apologies if this question was asked before, I could not find a search feature. What happens if my parents passports are expired at the moment? I understand they will have to renew to get the final visa, but do they have to renew now for this application? Some of the forms ask passport expiry date.
