Do you have ruksati photos and did you send casual photos of you two together. Nikkah over Skype doesn't seem to work much with them. Were your relatives present during your wedding? If so, did you write an explanation of each individual in photos, dates etc ?
The person handling the case is a F'ing idiot not everybody has to have the same situation we are living in 2018 not 1960s. A lot of people have nikah only cases and not every relationship is the same. Many have one function events as well. Definitely appeal this if they reject I would explain this to them as well. EVERY RELATIONSHIP ISN'T THE SAME
Yes, I did sent them our Walima/Rukhsati photos & casual photos of our trip to Naran, B'day & Nikkah Anniversary celebration. I wrote explanation on each photo mentioning the date, event & people in photos.
Telephonic or Skype Nikkah is considered proxy marriage but this rule became effective in July 2015. I had my Nikkah done in 2013 & Rukhsati in July 2016.
Rukhsati has no legal standing even in Pakistan. You cannot go to NADRA and update your husbands name by telling them you don't have a NN but Rukhsati did happen. They will turn you away. So the CIC officer is justified in their doubts because if you apply under spousal sponsorship then you must meet the spousal sponsorship requirements and one of the biggest ones is that the marriage i.e. Nikkah must be performed with both bride and groom physically present.
Okay this is basically a proxy marriage and not considered legal in Canada. I would agree that you now need a lawyer. Whether or not you lived with the husband, or got pregnant are irrelevant because you have applied under the spousal sponsorship and as per CIC he does not qualify as your husband. If you had lived with him straight for a year, you could have applied under common law but I am not sure if Pakistani's can apply in that category.
I think the rule about CIC not accepting proxy marriages became effective in 2015.
What confuses me is CIC officer asking me this:
• " You have also provided no evidence of a rukhsati ceremony"
• "Please provide an explanation & clarify if a rukhsati was held (photographs)"
▪ Whereas, I've provided them with 3 days event photos, Rukhsati photos, original walima card & some casual post wedding photos with the application.
▪ I'm currently in Isb, Pakistan & don't know of any immigration lawyer. Should I return to Canada & consult with lawyer there. Please suggest?

You should explain everything to them and if they reject you can always appeal it. Perhaps resend things. At this point you will likely have to return. Or since you are in Pakistan why don't you send them proper documentation of your nikah like a nikah nama and the NADRA registered one.

that BGC is basically Canada sending USA the PA's info and waiting for them to get a reply back .. it's not the actual BGC that happens with LVO .. so, sit back and wait for the actual one to start which could take months ..
yes just like humy said. Send whatever they asked for even though you may have sent it before. they c
This time make sure to explain each picture also. Put a cover letter explaining the situation in detail. have you guys been living together? i think they say that if you have been living together it can be assessed as common law.
but i wonder how would one go about proving marriage if initially it was done by proxy? do the couples have to get married again?
Marriage where one or both parties are not physically present (e.g. proxy, telephone, fax, Internet)
Proxy, telephone, fax, Internet or similar forms of marriage where one or both parties are not physically present are excluded relationships in all temporary and permanent immigration programs [R5,
R117(9)(c.1), or R125(1)(c.1)].
Proxy marriage is defined as a marriage in which one or both of the participants are not physically present, but they are represented by another person who attends the solemnization. A telephone, fax or Internet marriage is a marriage in which one or both of the participants are not physically present at the same location, but participate in the solemnization of the marriage by telephone, fax, Internet or other means (e.g. Skype or FaceTime). It is possible that someone other than the persons getting married participates on their behalf as well as over the telephone, by fax, Internet or other means.
Applications received by IRCC
before June 11, 2015, from persons married by proxy, telephone, fax or Internet are not subject to this exclusion.
To be considered physically present at a marriage ceremony, both parties (e.g. sponsor and spouse or principal applicant and accompanying spouse) must have participated in a wedding ceremony in person.
Note: Couples who have been married by proxy who have been living together may have their relationship assessed to determine if it meets the requirements of a common-law relationship.
