AsSalamualaikum Guys'
I'm not an active member here, but would be really grateful if you could please help me out.
I am a Canadian citizen, sponsoring my husband who currently resides in Isb, Pakistan. We had our Nikkah ceremony in March 2013, & had our Mehndi, Baraat & Walima/Rukhsati in July 2016. I stayed with my husband for 4 months, & was pregnant at that time but unfortunately suffered a miscarriage. I returned to Canada in Nov, 2016. I revisited my husband in April, 2017..& has been living with him in Pak for over a year.
I've submitted my 3 days ceremony photos, pregnancy report & ticket proofs with application.
Application received in Mississauga:May 8, 2017
Started processing on June 28, 2017
Medical passed in July 2017.
Today, my husband recieved an email. •" You don't appear to meet the requirements: you've stated that your sponsor was not physically present for the marriage ceremony which means you cannot legally be considered a spouse for the purposes of immigration to Canada."
•"Your marriage is not genuine. "
•" You have stated that you first met in Dubai and resided together in May 2016 prior to reception. It appears unusual according to cultural norms that you resided with eachother prior to the your cermonies."
• " You have also provided no evidence of a rukhsati ceremony"
• "Please provide an explanation and clarify if a rukhsati was held (photographs)."
•" They have asked to submit additional information to these concerns within 30 days from today."
What should I do? I have submitted 20 photos of our ceremonies. I met my husband who was on visit visa in Dubai during over stopover to Pak for few hours in presence of my siblings.
What should I do now? I'm really stressed out. Please help me with this email.
Thanks !

Do you have ruksati photos and did you send casual photos of you two together. Nikkah over Skype doesn't seem to work much with them. Were your relatives present during your wedding? If so, did you write an explanation of each individual in photos, dates etc ?
The person handling the case is a F'ing idiot not everybody has to have the same situation we are living in 2018 not 1960s. A lot of people have nikah only cases and not every relationship is the same. Many have one function events as well. Definitely appeal this if they reject I would explain this to them as well. EVERY RELATIONSHIP ISN'T THE SAME

Okay this is basically a proxy marriage and not considered legal in Canada. I would agree that you now need a lawyer. Whether or not you lived with the husband, or got pregnant are irrelevant because you have applied under the spousal sponsorship and as per CIC he does not qualify as your husband. If you had lived with him straight for a year, you could have applied under common law but I am not sure if Pakistani's can apply in that category.
damn what the hell! still waiting and when is the interview? I am so sorry you are still waiting this is ridiculous. Wish you both lots of patience and sending all the good vibes your way.

Rukhsati has no legal standing even in Pakistan. You cannot go to NADRA and update your husbands name by telling them you don't have a NN but Rukhsati did happen. They will turn you away. So the CIC officer is justified in their doubts because if you apply under spousal sponsorship then you must meet the spousal sponsorship requirements and one of the biggest ones is that the marriage i.e. Nikkah must be performed with both bride and groom physically present.

Yup sucks big time, remember how concerned and worried you were at the time. We don't even expect ours to be done within 10 months anymore LOL..just expecting some sort of movement. I'm hoping they don't reject for some God knows what reason or that they process it hopefully by the so called "12" month period.
