Hello, everybody,
I am applying for PR right now via Canadian Experience Class. I have been in Canada for one and half years, and had worked experience the same period of time. In the beginning of December, I got invitation for applying permanent residency. I have a few questions about the supporting documents required, one is "Offer of Employment" and "Letter of Employment".
In terms of "Offer of Employment", Just quote from CIC website explanation:
"You must provide a job offer letter from the employer who wants to hire you. It must be printed on company letterhead, and state that you will be employed
permanently in Canada by that company. The letter must specify whether the job is:
- for continuous, paid, full-time work (at least 30 hours a week),
- for work that is permanent and not seasonal,
- skill type 0, or skill levels A or B of the 2011 National Occupational Classification (NOC)
It says you must provide permanent offer, which I do not have at the moment, its valid only for one year. So how could I fix it?
For "Letter of Employment", is it just the one of job offer or something else?
Thanks a lot!
Hello, everybody,
I have a few questions about the supporting documents required, one is "Offer of Employment" and "Letter of Employment".
They are very different documents.
In terms of "Offer of Employment", Just quote from CIC website explanation:
You only need to provide this if you are claiming points for having a valid job offer. It sounds like you do not, but you can read here:
http://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=695&top=29
If you do not have a valid job offer, you do not need to provide a job offer letter : )
For "Letter of Employment", is it just the one of job offer or something else?
No. This letter is your employer's testimony about the work experience you have gained - it is in the past (job offer is for future employment). It is the single most important document you need to provide to prove your skilled work experience.
You can read the requirements for the letter (also called reference letter or experience letter) here, under "Proof of work experience"

Thanks for replying and answering, very much appreciated.
I do have a valid job offer, but it's effective only til June 2018. But most likely I will have another one year contract. Should I just decline this invitation and await the new offer?
Also thanks for the link, I will read over thoroughly.

Then it does not meet IRCC's definition of a valid job offer.

Check first to see if you were actually awarded points for the job offer. No need to decline if you did not receive the extra points.

It will help a lot : )
Thanks for quick answering,
I was actually awarded points of the job offer, as when I set up the EE profile where I used the same offer and same period of time, and I actually got awarded point, as shown:
CRS - Spouse - Canadian Work Experience 0
CRS - Skill Transferability - Education 50
CRS - Skill Transferability - Foreign Work Experience 0
CRS - Additional - French Proficiency or Bilingualism 0
CRS - Additional - PR or Canadian Sibling 0
CRS - Skill Transferability - Certificate of Qualification 0
CRS - Canadian education 0
CRS - Arranged Employment 50
Provincial/Territorial Nomination 0
So if it had been the valid offer, I would not have been awarded points, right?

??? If it had been a valid offer, you would have been awarded points, and you could be confident that the VO who reviews your case will let you keep those points.
Unfortunately, if you answer the questions wrong, you can still be awarded points; when the VO reviews your case and determines that your offer does not meet the definition, then they will deduct those 50 points from your CRS score.
If you deduct the 50 points, does your CRS score stay above the low score for your draw? If yes, then you can apply anyway (with a letter of explanation). If not, your application will most likely be refused.
What kind of work permit do you have, do you have an LMIA, and is it possible your employer would be willing to write a new letter?

Thanks, I do not think the CRS will be staying above the minimal score if the 50 points deduction would be made.
Yes, I do have an LMIA, its positive. I have realized now my offer is effective till May 2019, should be good enough. Thanks for the help!

Unfortunately it may still not be good enough as per CIC rules the job offer should be "
for at least one year after we issue your permanent resident visa" (this is often the issue as employers do not always want to add this bit in the job offer letter). See
https://www.canada.ca/en/immigratio...e-candidate/eligibility/offer-employment.html
As there is no guarantee that you will receive your PR by May 2018, there is in my opinion little chance that the officer who will review your application will be satisfied that you can claim the arranged employment points.
If you do not have enough points without the job offer (you want to be 100% of that), my best advice would be to:
- Have a serious talk with your employer, explain the situation and ask her to modify the job offer to comply with CIC's requirements. This is a long shot but worth trying. In practice most PR applications take no longer than 6 months, so you would just end up working a few extra months (e.g., up to June or July 2019), and your employer may be OK with that.
- Decline the ITA and work on improving your CRS

Thanks for replying and your suggestion, thats terrible, CIC policy is that strict?

It IS better to have a letter with the words "for at least one year after becoming a permanent resident", but if May 2019 is what is on your job offer letter, that's great news. In my opinion, this will be good enough. People with LMIAs tend to get a little more slack, and there's a good chance (if you apply right away) that your application will be finalized by then. Good luck!

Thanks for replying,
Yes, my job offer ends at 31 May 2019. And I have positive LMIA. I just did recalculation of CRS, I still got 448 without the job offer, should I just continue on application, or decline it and apply for one without job offer, because I have to collect all my documents and do the medical test.

If that is above the lowest score for your draw, then you should definitely apply, since it will have no impact on your application even if you were to lose the points.

Just my opinion - first, I would see if your employer would be willing to re-word the letter. (The benefit to them - no more LMIAs and work permits!!!). Even so, I would probably apply. But that's up to you. Hard to say how quickly you would receive a new ITA, you seem to be close to the current cut-off.
Thanks for the advice. I doubt that my employer would be willing to re-word the offer. My current ITA deadline is March, 7 2018, still some times to go though. As you said, this 50 additional points is not guaranteed. I shall see what I'd want to do. Speaking of the points, do you know if the points that generated by the CRS calculator is somehow different from the one showing on your profile?
And what if i'd decline the ITA, my profile still in the pool? or I have to set up a new profile by not including the job offer?
Thanks!
If decline you will be back in the pool, you can then edit your profile if you wish not to claim those 50 points.

Ok, got it, thanks a lot for all the help! Merry Christmas and Happy new year!
