You don't have a representative? So how did your wife know about stopping appeal. She maybe sign something she didn't know she was signing? Is there anything in notes that is news to you?
Wait, didn't you actually win the appeal the first time? Did you end up withdrawing after you won? Maybe your lawyer didn't send the updated forms to them before the deadline? After you win the appeal, when they e-mail you, you have 60 days to send them the updated forms and documents, maybe you guys missed that deadline and CIC considered it as abandoned? Honestly, your lawyer should be on top of these things. I hope it wasn't him that forgot to send in your stuff, otherwise most of your trouble is technically his fault.

Quite frankly I don't trust people, and I don't trust lawyers, so it wouldn't be surprising if he did this on purpose to get double the money since the case would obviously take a lot longer if you processed it twice as opposed to appealing, winning and getting in. Such a shame when you pay someone so much money and you hope you can trust them and they just leave you in the dark the whole time. I hope the MP is able to help them out.

Ismaeel, your wife needs to take her copy of the blue book. Tell her to explain the situation. That other ppl on appeal forum, believe there maybe some misconduct on behalf of the lawyer. In order to possibly charge more fees. And that we also think you been refused twice for same reason. Whether your appeal was withdrawn or not.

No not yet MP is out of the city but she will soon visit her soon....first lawyer was an afghan and he did some mistakes in filling application forms now we have an pakistani lawyer he seems intellegent...

Well you need to talk with her more. Your life together is very important. Who is her mp. I can maybe tweet him or her. There was quite a few for Mississauga. Otherwise you will keep repeating mistakes.

I'd recommend you guys discuss the situation, she may not even be aware that this happened and may be just as confused as you. I'd also make sure she talks about that with the MP, mention everything that has happened and the mistakes that were made, the MP will phone CIC and ask for information on your file and then she'll most likely let you know what's going on. You shouldn't have had to appeal twice, and I'm starting to think that the only reason why you got refused twice is because your lawyer withdrew after winning the appeal, either by not sending the documents within the allotted time or for some other reason. You should have your wife bring all the notes to the MP if she also has a copy of them.
Still think you can't be refused twice for same reason. Hopefully all gets straightened here soon. Whether you appeal or not. I have heard of ppl stopping the appeal and reapplying. So even though they dont specifically answer to refusal reasons. Cic can't repeat. Am hoping it gets resolved sooner.

You can get refused twice for the same reason if your situation didn't change/you didn't convince an officer or a judge the first time. If you apply and get refused, then you simply decide to reapply instead of appealing, and then the officer is still not convinced, then they could refuse you again because there was no appeal involved after the first refusal. But according the ismaael he did win his first appeal so all I can think of is they withdrew after winning, so in that case, no, he couldn't get refused for the same reason, since there was an official letter saying he no longer fell under 4 (1) of the IRPA. Hopefully his wife gets the MP to read the notes. I don't think they get involved or take any action once you are in the hands of the IAD though, that's what they told me when I asked them for help.
