That doesn't matter. All that matters is if you lived together for a year or more. You lived together for more than a year - this means you were common law.
He can't lie in his application about this. If he attempts to lie - the lie will almost certainly be caught during background checks and then he will be banned from Canada for 5 years.

My boyfriend from Philippines is planning to apply for a tourist canada visa, as soon as he got here our plan is he’ll apply for a work permit so he can work while we’re waiting for he’s permanent residence status. So my question is can he apply for a work permit under his canadian tourist visa? I don’t want to sponsor him directly cos we’re looking forward to the fastest way cos our daughter is growing up without him beside her. So anyone can help me up with this? Unfortunately I think you need to focus on getting the TRV. I think you will find that it will be very difficult given his child lives in Canada. I'm not sure his financial and job status which also will contribute to whether the TRV is approved.
Please I need ideas. I applied for open work permit in Canada as my wife is a student there. My work permit is still pending on medical which I will complete in march. But my visitors visa is going to expire by the first week of march by which time I intend to reapply for another visitors visa while waiting to complete my medical. My question is should I apply again as visitor (tourism) or as a family visitor since my wife is there. If i apply as a family visitor ,they will as of medical which I have not completed meaning longer processing time and if I go for tourism what will they think of my pending open work permit .
