Work permit on implied status

Hi,
Recently my visa got expired while being in canada and my consultant had put an extension which gives me implied status.
My question is can i flagpol on implied status when i have my LMIA in hand?

No. You can only flagpole with a valid TRV or work permit.

What type of visa expired? Read through the link if you can work on implied status. If you don’t know talk to your lawyer. Your lawyer would know about this so assume not eligible.

No you can’t flagpole as are on implied status. You need to wait for a response. Nothing to do but wait. What is the NOC?

my NOC is 4163.
my problem is that i need to travel asap.
i have my LMIA in hand and on a implied status and i am afraid if i leave canada i might loose the status and cannot enter canada
i am clueless now

You need a TRV to come back. You need a work permit to work. Did you apply for a TRV because extension is not a TRV. Apply for a TRV.

applied for an extension becuase my visa was expiring while being in canada
so no way that i can flagpole on my lmia (if i show it to the canadian border)

An extension is only to stay in Canada. You cannot flagpole without a valid TRV. Don’t even think you are eligible to flagpole with a TRV. Have you read the rules for flagpoling?


The following foreign nationals are permitted to Flagpole:

1. Residents of visa-exempt countries with an LMIA-exempt job.
2. Residents of visa-exempt countries in possession of a positive LMIA.
3. Residents of the U.S., St. Pierre & Miquelon and Greenland.
4. Residents of visa-required countries already in possession of a study or work permit (flagpoling for the purposes of renewal).

If we get the approved Visitor Extension and the TRV is expired then Can we do the flagpole or not?

Would not try it because you don’t have a valid TRV. An extension is only to stay in Canada. Once you leave, it is not longer valid.

Hi guys

i just finished my 2 year course wants to do flagpoling at the moment i m in port alberni, bc which is the nearest border for flagpoling, also if possible what is timing for flagpolling.

please help need guidance asap
