Hola, does anyone know of any success in getting a Visitor Visa for a Cuban spouse? My husband and I are working on the sponsorship papers (getting close), I would like him to come and see Canada before moving here.
Also - for the Medical - he has a son, 4 years, but he does not have custody of him, his son lives full time with his mother, my husband pays monthly support as per the rules in Cuba. Does he need to get a medical for his son? We have no plans to bring his son to Canada; we also have a pre nuptial agreement that states that I will never attempt to gain any type of parental status or provide financial support for his son.
The main thing with a visitors visa is being able to prove that he has enough left for him in Cuba that he will return when his visa expires. You can show that he has a good job, that his son will be there, that he owns property, that he has a significant sum of money in the bank, etc. because you are married it will make it more difficult and if you have a perminant residency application pending you will most likely not be approved.
My spouse is Costa Rican and poor by our standards. We applied for a visitors visa for him before we were even engaged and were denied. However he only could prove that he owned property and had a job, not necessarily a good one either. He doesn't have any children.
As for the medical, the son should get one. If the mother refuses or you decide not to then, as I understand it, you will never be able to sponsor his son to come to Canada in the future. Although you have no plans for it now you never know what could happen in the future and I would recommend that you keep that option open. God forbid something happen to his mother, or maybe you might decide to offer to bring him here to go to university, who knows what could happen as the child is only 4 right now.
