So my Fiance and I have just about finished up our -sponsorship/conjucal relationship application. We have been together for almost 4 years now, and going through the best ways for myself as an American to immigrate and live in Canada, we found the conjucal path best suited. However upon finishing up the application, the part where providing reasons on why you could not marry came up and stopped us. I am able to go over the border and her as well vise versa to marry legally, but we are not ready to get married financially/other. We want to marry when I am in Canada living, and we have settled down. So now comes the issue on what do we do? Can I simply state these reasonings in the application, or do we have to start from scratch with a new application? I am currently working in retail, no professional skills, what is the best way to go about this?
Thank you for your time everyone.
If you apply as conjugal - you'll be refused. To be approved under conjugal - you must face real immigration barriers to getting married and/or becoming common law. Americans don't face these barriers. You need to either get married - or live together for a year continuously first (before you can apply).
So how should we go about this? Get married legally, and re-apply as what? and if living together option how would we go about this? Visitor visa and live together?
Yes - you have two options. The first is to get married and then submit your application as a married couple. The second is to live together for a year before you submit your application as a common law couple. There are a number of ways you could live together. You can come as a visitor to Canada or she can come as a visitor to the US or you can live together in a third country. It's really up to you.
However definitely do not apply as conjugal. Refusal is guaranteed. You don't meet the conjugal requirements.
Thank you both. I am assuming marriage is the easiest way then? I am trying to go through the canadian see if you apply section, and I keep getting We used your answers to see if you may qualify for any of Canada's primary immigration programs. Based on your answers, it appears that you are not eligible to immigrate to Canada at this time under a federal program.
You don't need a visitor visa. You can visit Canada on your US passport alone. However how long you are actually allowed into Canada is always up to the CBSA officer you encounter at the border (even if you had a visitor visa).

once allowed into canada, you can then apply to extend your stay as a visitor so you can live together and qualify for commonlaw. when in canada as a visitor, you can not work for a canadian employer. you CAN work remotely for a US employer if you have that option.
