Student Direct Stream with Spouse as Applicant

Dear Concerned,

I want to ask that if a person has been banned for 5 years due to misrepresentation of material facts in immigration application back in 2016. Can he be included in the application of his wife for Student Direct Stream?

Will ge be allowed to accompany his wife and kid for the studies?

A 5 year ban is a 5 year ban. She may also be inadmissible as she has an inadmissible family member.

She will have to mention on her application that shes married and to whom. They will check your information that you're banned and she will be inadmissible because of you.

She won't be banned because of you but you'll be separated until your ban is over unless she visits you. Depending on the reason for your ban it could influence her approval.

IRCC website states that the family member (temporary residents will be inadmissible only if the admissible member has been banned due to security, international or human rights violations, or organized criminality.
