My husband is a Canadian citizen but living in the US on an expired student visa. His family came to the US when he was a baby and never left. They applied for a US social security number and just lived and worked here for over 20 years. Well, eventually some of his siblings moved back, and one of his siblings went to visit and was banned from coming back to the US. Then his parents had to move to Canada because one of his siblings was sick and they were also banned from coming back, so he is the only one left in the US now.
My husband went back to Canada after high school and took a few college classes, then came back to the US on a student visa and took some more classes and never went back to Canada since then.
We got married about 5 years ago and his parents wanted us to submit the paperwork for him to get his US citizenship/green card but we never submitted them. Now, we are thinking of moving to Canada instead of staying in the US.
Will he still be able to sponsor me for PR while we both live in the states?
Should we try to fix his status here in the US first?
If his family owns a business in Canada, would it be acceptable if they offer either of us a job there? Will that make things go faster/easier?
When we move we plan on living with his parents then eventually buying a house. We also have a child together so both of us don't want to risk getting separated.
Yes he is by birth, I just wasn't sure if his status here in the US had any effect on it. I think that if he goes to Canada he will not be allowed back in US because of the overstay. We really want to move up there to be close to his parents, but I'm afraid if we moved, there could also be a chance of me getting sent back to the US for whatever reason ??? And we don't want to get separated. I don't know really, I'm just getting started researching all of this.
If he leaves the US, he'll be automatically banned for 10 years from re-entering. Just keep that in mind as you're making decisions about what to do next.

Yes that is my fear. His family is very close to their priority date for a family sponsored visa to US they have been waiting for 20 years. Would the best bet be to wait for that to go through and then decide what we want to do/where we want to live? I don't know if we should start the process for me to become a PR already or should wait for his visa/status to be straightened out
