Hi all,

About to undertake inland sponsorship of my American partner, I am born Canadian. Our plan is for her to arrive on visitor visa and begin the application process. If she has to leave during the processing time for AOR+work permit due to running out of her 6 month stay, will that effect the application, or can it continue after she has returned to the states?

Thank you!

Instead of leaving, it would make more sense to extend her visit:

Am I correct in understanding that as an American my partner automatically gets temporary resident status upon entering the country?

Edit: In planning to begin the inland sponsorship process, will my partner need to apply for the TRV to be able to start the process, and apply for an open work permit?

Thank you

Yes, assuming your partner is allowed into Canada, they will have temporary resident status for the length of time they allowed in (typically this is a default six months but can be shorter).

Yes, you can submit the inland sponsorship application based on this. The open work permit cannot be submitted until you have AOR from the spousal sponsorship application which takes around 2-3 months after that application is submitted.

Seeking clarification on part of the sponsor application. Where it says if your application is not approved, I guess if you are not approved as sponsor, do you want to cancel and have fees returned or proceed with PR application. Does proceeding mean the applicant (spouse you are sponsoring) can proceed on his own for PR? If not, what does that part mean?

No, it doesn't mean that. It means that you are telling IRCC to keep processing the application even though the sponsor has been refused. This means the application will be refused but you will have a chance to appeal the refusal.

I have a question.

My wife lives in Germany, and she was asked for a FBI clearance. The letter says we have 30 days to respond, but the FBI clearance are going to take longer than that, as we mailed them to the U.S and we have to wait until they come back. Will this be an issue, also the online protal shows that her background verification is complete. Everything shows complete in the online portal. I have tried reaching out to immigration, but I cant get anyone.

Can someone, please help me out on this?
