Many cases are FRAUD and many have children Visa Officers know better then us and can make mistakes they are human. But when a husbands says to his wife don't come and has never seen his daughter what would your instincts tell you???
I don't know what's the real basis for rejecting our file. Regardless of having a baby or not, I feel like I wasn't given a fair chance to explain my situation. They could've asked for more proofs to validate our relationship. They could've asked for me to visit Pakistan, come in for an interview etc. I have both English and Urdu nikkanama and it's as real as everyone's here. If they seem to find a 'red flag' with the nikkanama, they could've asked me/lawyer and I'm sure there could've been ways to prove the validity. They can't put me on a trial, give sentence and close the case without asking if I'm pleading guilty/not guilty. Then it's not a fair trial, it's a ruling!

You should have the right to appeal. I mean if everything is legit. Then I don't see any problem. Where is your daughter and your husband. Are they in Pakistan?. Does your husband wants to come here. Clearly the officers are seeing something that we don't know. What does the lawyer say

For everyone who's freaking out or getting concerned about their cases, here's a little background on my case:
Timeline to the left. E-cas decision made on Feb 3rd, 2015. No letter or email was sent so I kept asking my lawyer and my MP. MP said that she received some reply but kept stalling in tell me the real response from CIC. I received my GCM notes today in which they had written that on multiple times they requested my urdu Nikkanama and I had only provided English one which raised concerns for the validity of the marriage (I've sent my urdu nikkanama twice before!). Notes also mentioned that I was missing IMM5406. I have all the documents, so this morning I resent my Urdu Nikkanama and IMM5406 to LVO on the email they provided on their website. Based on that my case MAYBE rejected.
So then I called my MP back and to which she said now that you know your case has been rejected, I can disclose this information to you. Even though my notes states that it could be rejected, my MP said that it is rejected with no way to appeal and if I want to apply, I'll have to wait 3 years before they'll accept my application.
There's no funny business here - My case and my marriage is legit. My lawyer misrepresented my case and messed up my file.

you shouldn't have done that. you should have signed same on every paper (documents, nikah forms, supporting documents). All needed to be signed as a same style and writing.
Affidavit should be ok, because it's an offical paper, and oath commisioner is signing it stating, what ever is stated in the affidavit that it is true.
MAKE SURE OATH COMMISIONER STAMPS AND SIGNS HIS NAME AND DATE

That's what I think - I want to appeal but the MP is saying that in my case there's no request to appeal. My daughter is in Canada with me, my husband is in Pakistan. Who doesn't want to come to Canada Sohaib1?

You should had prepared an affidavit stating that you had alredy sent a urdu nikahnama twice. The marrige is legit.
Coverletter would have worked too.
That could be too if you were missing something like (IMM5406).
SUE THE LAWYER FOR MESSING UP EVERYTHING (wasn't he checking the checklist to make sure all documentation are complete and they are in the package)
In my case I only submitted english certificate too, as all my family and friends did, and they all got approved

Really I felt my heart sink after hearing this news of refusal of your case..dear sister did u send your original urdu nikkah nama by post to your visa office OR u sent them scanned copy of your urdu nikah nama by email..Make it clear ,,,cic needs everything original and in paper , not scanned copy by e mail..

I think MP is full of it. She doesn't know what she is talkin about. I am preety sure you can appeal. I will pray hard for you and everyone and ofcourse for myself as well. Appealing is your right

I only got to know about the rejection today - that too from my MP. I had no idea about everything that was missing. I don't even know what to do anymore

OMG, I am to shocked and really really sad for you and your loved ones. This lawyer thing is mostly ****. May Allah help you to come out of this situation. There is a thread in this forum for appeal cases and related stuff. I would suggest you to try reading that and find a way to support your case. Appeal and reapply are almost same (To an extent as per my info).
