I'm in Canada on an open work permit. I received an OWP because my spouse is a "foreign student". However, my spouse dropped out of school about 7 months ago (shortly after their study permit was renewed for 4 years).
My questions are: am I allowed to keep working? Could I get in trouble with CIC because my spouse has stopped studying?
You and your spouse should take a look at http://www.cic.gc.ca/english/study/study-changes.asp
An excerpt: As of June 1, 2014, all study permit holders in Canada will need to actively pursue studies. This means that:
• if you hold a study permit, you must remain enrolled and make reasonable and timely progress towards completing your program; and
• failing to do so could lead to your removal from Canada.
Your educational institution will report to CIC on your continued enrolment and academic status. You may also be asked by an immigration officer to provide evidence of your continued enrolment and academic status.
Do you think CIC will apply the new rules retroactively? In other words, if they find out my spouse hasn't been studying (prior to June 1st) could we still be removed from Canada?
Furthermore, If I can get my spouse to start studying in June would we still be at risk for removal?
