Sponsoring family with an expired PR card

Thank you for this very useful forum. I am asking for help & advice, and just joined, although have visited the forum many times before. It has been a long process for us to move to Canada and here is our current situation & my query:

My husband is in Canada. His PR card has expired, and he has not fulfilled the requirement (stay in the country during the last 5 years) to renew his card yet. He wanted to move to Canada as soon as his PR was granted, but his professional registration application took literally (and unexpectedly) years, and so the move was delayed up until the last month of his PR card. Of course he has visited Canada (where we have relatives) during the last five years, but to fulfil the requirement of stay in order to renew the PR card will take a while.

In the mean while I am in the UK with our child, as I also have to work.

The question is: Can my husband sponsor me at any time although his PR card has expired?

Your husband must meet the residency obligation (i.e. have lived in Canada for 2 out of the last 5 years) in order to sponsor you. If he doesn't, he should wait until he has lived in Canada long enough and then file the application. If he doesn't wait and files your sponsorship application before he meets residency obligations, it's quite possible CIC will be alerted to the fact that he doesn't meet the residency obligation, refuse the sponsorship application and begin the process of revoking his PR status.

Long story short - your husband needs to wait until he meet the PR residency requirement before submitting the application to sponsor you.

Would my husband's status be flagged up if I submit any other kind of visa application, for example student, work permit/ provincial nominee (as in the application I would need to declare him as my family member)?
