I am a Canadian legally married to an American since 2007. We were going to stay here in Canada, but my ex was threatening us, so we went to the States for a while. We then decided I should immigrate there, but I made a mistake and bought property there after selling mine in Canada. We hadn't filed the immigration papers yet, so we decided to go to Canada for the long weekend, and then return to fill them out. They wouldn't let me back in the US, saying I had overstayed. Well...I had a panic attack and the border police asked why. So I told them I was afraid of returning to Canada, as my ex was threatening, and I had no where to go. They told me I, as a Canadian could file for ASYLUM. I had no idea, so I asked them what I had to do. They told me I had to go to jail for a few days while a judge reviewed my case. I consulted with my husband, and we agree to do it. I spent 2.5 months IN JAIL before a judge saw my case, and then I was deported for 5 years !!
My husband, who does not have a US passport because he owes child support, crossed the border in the summer so he could be with me in Canada. We filed sponsorship papers for him here.
My question is, will he be able to stay without a passport, as he crossed the border during the "grace period'?
