Hello,

I had applied for my spouse open permit in Oct 26th 2023 but no result yet. She is my dependent.
I am working in Canada as a temporary resident and working and my work permit have validity of till 2025 May.
Question : Is there any possibility of rejection chances for my spouse permit ?
Do you need to show the strong ties for my case as well?
I have given my pay slips and tax forms.
There is always chance of refusal. Is spouse in Canada? If not, where did spouse apply from.
 
I had applied for my SOWP back in june 2023 and it got rejected. Now I will be applying again so my question is:
1. Do I have to add any additional documents or forms due to the refusal? (Given that i attached everything required the first time)
2. I had applied from India but I was working in UAE. Does that affect the application? (I now plan to apply from UAE itself, rather than India)

The reasons given:

• I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 200(1)(b) of the IRPR (https://laws.justice.gc.ca/eng/regulations/SOR-2002-227/section-200.html). I am refusing your application because you have not established that you will leave Canada, based on the following factors:
• You do not have significant family ties outside Canada.
• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.
• Your current employment situation does not show that you are financially established in your country of residence.
• Your immigration status outside your country of nationality or habitual residence.

I applied for dependent notes twice but never received them.
Any help would be highly appreciated.

Your situation is so similar to mine even the name for a while I was thinking when did I post .. can u let me know what's the update now ? I have applied for notes just last week waiting now to apply for reconsideration.

I applied for the notes but they werent helpful at all, took around $30 to just repeat the same that was given in the refusal letter. It takes almost 30 days to get the GCMS notes. My refusal was last year, 30 june 2023. So after preparing the same documents I reapplied on 14th March 2024. The application is in process, from what I have seen its taking 5+ months to get a decision. So waiting it out.

Hope you get the positive results. Since I'm from PG Diploma course I can't reapply because of rules changed.. I can only ask for reconsideration or else wait till i finish studies and get work permit only then I can apply.

My wife is also on PG Diploma but I applied before March 19th so I hope that counts.

I had applied again on March 14, it had exceeded the mentioned processing time. So I reached out to my MP for an update.
They informed that my application is non-routine, what could that mean?

It is non routine because of changes to SOWP as you would not be eligible under current rules and assume you applied from a country you are not living in.
 
Yes it was addressed and POF were shown, but wife's study permit will expire in 3 months.
IRCC will usually not process a SOWP if study or work permit is expiring within 6 months. You may get lucky. May be best for spouse to apply for PGWP with job and paystubs and apply for SOWP then.

Would it be better to file both together? Considering inland PGWP is taking quite some time to be processed as well..

Does your spouse have a job and are they working?
