Hi all, I would like to ask whether criminal record about drug possession and selling (drug name: sibutramine) with sentence 6 weeks with 1 year reprieve(suspend) will affect my Spouse open work permit application? Can I apply for rehabilitation?
Details as below:
Year of offence: 2010
Sentence put into court: 2011
According to Hong Kong law, the offence will be marked "spent" in Certificate of No Criminal Conviction by Police Officer.

You will need to apply for rehabilitation and get approved before you can apply for a SOWP. I would submit the rehab application as soon as possible. Processing times can be quite long.

Thanks for your prompt reply. May I know how long will it take and is it possible to get the rehabilitation approved?
May I know what kind of documents are needed in this case (court details, etc)? Thanks!

Yes, this impacts an eTA. You are inadmissible at this time to Canada, meaning you cannot enter the country until the rehabilitation application is processed and approved.
Yes, you must mention this conviction when applying for an eTA. Failure to do so is misrepresentation which can result in a five year ban from Canada.

Did you manage to get this sorted? My friend is applying for OWP and her conviction only becomes spent in December 2022 for assault. Was your visa approved?
