She has to be PR. your sister has to be a residence of Canada and living in Canada.

Even if your sisters application is not submitted you will get 15 points . I am not sure if there is a minimum period of stay for your BIL.
Also, I jad my sister in Canada for 15 years . For some reason I did not get thr sibling points . Not sure if it was a technical issue . I wrote to them but by that time I got the ITA hence did not follow up
