Send a case specific inquiry and simply ask if your application can be changed from married to common law. It will likely take several weeks before you have an answer.
I would not wait for IRCC to ask. Based on the information you have provided, you are guaranteed to receive a fairness letter regarding the validity of your marriage. In this letter, IRCC will tell you they intent to deny your application based on your marriage not being valid and will ask you to prove your marriage is valid. Your marriage is not valid - so this won't be possible for you to prove. Anyway - ultimately your choice. I personally wouldn't wait.

Why did your lawyer let you submit the app knowing you weren't legally married? You need to be in contact with IRCC asap. Dont waste your time here, you need to speak with someone who can help fix the situation. As noted above, have it changed to common law, or restart your whole app.

As Scylla said, send a case specific inquiry. Do not wait. Time is important here. Also, talk to your lawyer about getting the explanation in quick as well. Cover all your bases.

There is nothing to be confused about. We have clearly explained it to you. Request the app be changed to common-law. If they refuse, withdraw and reapply.

It will not be fine. Your divorce decree is dated later than your second marriage. Your second marriage isn't valid. You're going to be refused if you take no action.

You cant be married to someone without knowing who they are. It doesn't sound legit too me. Hes not telling you the whole truth and has already done sham marriage in an attempt to gain access to another country. Please be very careful.
