Hi All,

My work permit extension application is refused, and I am given 90 days to restore my status.
I want to restore my status by applying for a visitor record. A few things confuse me,

1. on the CIC website, it says
"It is important to note that since status and authorization are not the same under the IRPA, an applicant can only restore their status to that of a temporary resident and to the authorization that they held immediately prior to the restoration application. ""

Since my last status was worker, can I not apply for restoration as a visitor by applying for a Visitor record?

2. When I tried to create an application from GC key, system asked what is my current status? There is no option for "out of status". What should I select?

3. Can someone guide me? If you can share any youtube tutorial, step by step process or any "what to do, what not to do", it will be more than appreciated.

I hope things were resolved for you! I am in the same boat as you and I am wondering if you could help me with it.
Were you able to apply for a Visitor record? if so, how? My last status was 'Worker' as well.
 
Hey @andynandy, I hope things will get better for you. I was lucky enough to get an ITA before my restoration period was ending. I didn't waste any time and submitted my full application and got e-AOR on the same day. I applied for restoration as a worker under BOWP as soon as I got the e-AOR. It will be a year of my permanent residency in June 2024. Please don't give up and look for every option possible. To get an ITA, I took 5 IELTS in 4 months. If you are in my past situation, I know how difficult time is for you, but everything will be fine, you just have to invest your full energy to get a way.

Apologies for the confusion. My work permit is expiring in August 2024 but my wife’s (who is also my dependent in my PR application)work permit extension application was rejected and she’s currently without status and has less than 90 days to apply for restoration.
Good news is that I have already got my AOR and completed the biometrics for my PR application.
As per current trends, I will hopefully get my COPR within next 60 days.
My question is, since I have more than 80 days left to apply for the restoration status, is it okay if I do not apply for the restoration status and simply wait for PR? or Do you think it’s mandatory to have an ‘active’ status for inland applicants and thus applying for the restoration status is a must?!

You may create risks for your application by not applying to restore your wife's status. Suggest she apply for restoration right away. Yes, inland applicants are required to maintain valid status.

What type of job offer ?
Do they already have a positive LMIA for the job ?
If not you’re looking at months. They have to advertise the job , pay the compliance fee and you have to wait .
You’re currently without status

Tnx! I got a job offer from a construction company and we just started the process 2 weeks ago. The immigration consultant that is working on it just submitted all the documents requested for SINP so we’re waiting for the SINP job approval letter to apply for LMIA and yes I am out of status now pls advise on what to do. Should I go back home or wait till my LMIA got approved?

My extension was refused last month on the 27th

Request a restoration as a visitor. That’s counter intuitive since one of the reasons you were refused was the reason you gave was to visit and then you sought out employment . Job offers don’t suddenly land in one’s mailbox . VO is aware that you weren’t and still aren’t a genuine visitor.
You took the six months here to seek employment
So you either request restoration , or leave and wait out the job offer process in your country . The job is not guaranteed to be approved

Thanks! Actually I never mentioned that I got a job offered when I applied for the visitor extension. I just mentioned to visit other provinces so my question is how to request for a restoration and is it right to ask the company that gave me the job offer to write a letter that they want to keep me in?
