Dear Friends
My case is rejected. Today i got letter from embassy. But i am bit worried about my refund. I paid 1100CAD while sending to CIC, Sydney and later on i update my son application fee 150 CAD to my visa office. So, from where my application fee will be refund? CIC, Sydeny or from my visa office.

The reason of my rejection is that my job duties are not matched with their NOC list. If my duties are not matched with their NOC list then why Central Intake Office allow me to send full documents to visa office, where I have mentioned same job duties in my initial applications.

One of my friend who has same degree and same job experience from same institution was qualified and got PR and mine case is rejected.
Anyway thanks to all members of this forum who gave lots of useful informations during this process.

If your application got rejected at your local chc after submission of complete documentation then you will not get a refund on processing fees.
CIO Sydney does an initial assessement for completeness, eligibility & adherence to ministerial instructions, if those are satisfied, then they forward your case to the local visa office for further processing. Thereafter when u submit your complete documentation, CHC does another eligibility review & that's the time probably your case got rejected.
At this stage their is no refund of application fees. :(
 
I was just wondering after reading many cases on this forum
is it a trick of CIC to earn money

let all or mostly candidates pass first stage and once he will
in process then reject him or her so he will not get any refund. ::)
 
right , NO refund at this stage.

its not trick to earn money, CIO sydeny just review based on experience only asI know, and CHC will review the case bottom to top level , my mean is local CHC will revieweverything, education , certification , experience etc. then they will decided that person is elligible or not under specific NOC. some people apply with adding some top lines in experience certificate and than after somewhere in experience certificate will not match with exact NOC job role, then it will sure get rejected.

What was your status before rejection recieved by visa office or in process?
 
Any chance to file an appeal or a Re-consideration request ?

I think the refund should be made until unless your e-case status turns to "In-Process" status.

My above comments are as per the following,

Appendix C – Procedures for missions: refunds by CIO-Sydney

This document details the procedures for cases where a refund by the CIO-Sydney is required. These procedures are intended to ensure that duplicate refunds do not occur and the appropriate level of financial controls is maintained.

These procedures apply to the following cases:

1. Uncreated cases sent from missions to the CIO:
Description: Cost recovery fee taken at mission, sent to CIO-Sydney for file creation and review. CIO recommends application for further assessment and e-transfers the file to the visa office. POS+ receipt remains at CIO-Sydney.
2. New applications received at the CIO directly from applicant:
Description: File created and cost recovery fee taken in Sydney. CIO recommends application for processing and e-transfers the file to the visa office. SAP (cost recovery) receipt remains at CIO.

Current holder

1. “Uncreated” files Visa office CIO-Sydney
2. New applications Visa office CIO-Sydney

NOTE: In both cases, the Visa Office is the current “holder” of the electronic B-file but the actual cost recovery receipt (POS+ or SAP) is at the CIO-Sydney.

1. Applicant submits a request to withdraw the application (before processing begins);
2. Applicant does not submit complete application package (including supporting documents) within the 120 s and visa office determines the application is NOT eligible for processing; or
3. Visa office determines the application is NOT eligible for processing upon review of applicant’s submission.

Dear friends i will get refund which is mentioned in the letter which i received today. But My question is from where they send CIC sydeny or local visa office?
If your file is rejected before "in Process" then you will get refund. So, don't worry friends.

If your file is refused at the stage of "Visa eligibility process" then you will get refunds.

AS you said it did rejected before ECAS changes to "In Process" it means, your process was not started and you are eligible for refund
 
Dear Dipendra,

Sorry to hear about your case. You said your friend was accepted who has same background as yours, then why dont you reapply by modyfying your job duties. you can get next experience letter from your employer indicating that there was a mistake in previous experience letter. One of the forum member did the the same and he got accepted second time.
