I am a canadian PR holder. I applied PR for my spouse from canada in July. He stays in US. I applied his through
buffalo office. After applying for his PR , i had to travel to India for few weeks. The status for sponsership
shows in progress (online) presently. It's around 41 days after cic started processing. I am soon returning back
to canada. Is it normal that it takes so much time or it is taking time as i was not in canada. Also after coming back to canada, i am planning to visit USA to stay with my husband for a while. Will it create problem. Pls suggest.
It depends what you mean by "takes so much time"... time for what? For him to recieve his visa, or just to to hear some news from CIC (Immigration Canada)?
I've heard that Buffalo (which handles all applicants from the US I beleive), is pretty slow. But then everyone says that about their visa office. It can't be worst than Moscow! For him to recieve his visa, count on a minimum of 2 to 3 months. I do stress minimum. Often it takes longer. If you mean news, whatever local office in Canada is handling your sponsorship application should give you some soon, after 41 days. I think CPC-Missisauga handles all Family Class cases. You should have at least a confirmation letter saying they recieved it. On there, there should be instructions on how to check the status of your applications online through ECAS (Immigration Canada Website). If you left Canada before receiving the letter, there's nothing much you can do until you get back, unless you call CIC from there.
Your being out of the country should have no effect on your application, unless you're not meeting PR residency requirements by being away too long/often. Someone please correct me if I'm wrong about that last part.
P.S. What IS it with everyone going to Pakistan and India?!? Am I missing out on something interesting? lol
According to CIC website, it takes 44 days now average to approve sponsorship for spouse so that's normal. That is just for the sponsorship approval, separate from the processing of PR for the sponsored spouse which depends on where they live and other things.
The only possible problem when you have something pending with immigration is if they send you a letter and ask for something and you are not there but you will be back soon though.
It's okay for you to visit the US once you get back, as long as you have a US visa for entry. (Question: Do Canadian PR holders need a US Visa to enter?)
Anyway, like Leon said, just make sure you don't miss any correspondence from CIC while you are out of the country.
