we need help, a family member became a citizen in 2015, in 2016, the minister of citizenship attempted to revoke her citizenship for misrepresentation. she went to federal court with other similar cases.. and the court grant her to keep her citizenship. In August 2018, The refugee protection division sent her a letter to vacate her refugee status. my question is, Can refugee protection division do that while she is an active Canadian citizen? are they following the correct protocol or order? because citizen comes first before refugee?
Yes, they can, at anytime, if they have proof of the misrepresentation. IRCC can revoke permanent residence and citizenship if it was acquired through misrepresentation. It doesn’t happen very often, but there are many instances of this happening and supported by the SCC.
