He can accept ITA but his CRS points with spouse must be above the points in that particular draw. And I assume if they fall on the lowest points in that draw he also needs to check if the tie rule would not be against him.

But, what if s/he entered EE as "unmarried" when actually s/he is married or by stating "spouse not accompanying". Will s/he be able to sponsor the spouse?

I might be missing some part of the chain in this conversation, but hopefully, I can still be helpful in weighing in...

If you are married, you cannot under any circumstances indicate that you are 'unmarried' (or 'single') in an application, even if your spouse is not accompanying you; this could amount to misrepresentation

If you are married but select 'spouse not accompanying', you should still be able to sponsor your spouse in the future once you are a PR (As far as I am aware). But you will have to go through the regular spousal sponsorship process and wait 12 months or more from when the application is filed, as well as meet any other requirements that are required to be eligible to sponsor someone, first.

I'm new to this immigration straggle and was wondering if anyone here can through any piece of advice my way.

So I'm at 424 (which is super low, and doesn't give me much chance) and on February I'll drop to 416 which is even lower.
I talked to a lawyer who said that even at 416 I can get in through OINP or EE because last year there were draws of under 420.

I'm a software engineer (or presume to be) with 9 in all CLB and don't speak a word of french, so my only option is a Masters degree.
The question is.... should I start a masters degree that will get me to 444-450 in two years (if I survive it) or wait as the lawyer said?
The masters is super ultra expensive so doing it just in case is not an option.

If you enter unmarried and you go through the process until landing then you can never sponsor your spouse to Canada. It is still better to correct it with explanation before you land.

Better than doimg masters is that you learn french which will fetch you 15 points I guess tgat makes your score around 431 and you stand a better chance . I too am at 434 and the scores will dip to this crs around march .Doing a 2 year program is useless at this point .Look for other alternatives like learning a new language .

Also if you have friends or someone out there try to get a job offer with lmia that would fetch you 50 points .

I think nomination from Ontario is a good option for you. If they invite you to apply, don’t miss it.

Not sure but i think IELTS must be valid at least until AOR. If it expires between ITA and AOR you must take a new test and submit those scores.

I am a Software Engineer as well, and I have gotten all my docs ready for Ontario NOI. As a Software Engineer, you have a great chance of being selected if your score is over 400.

I am on 421 as well. Waiting for next rounds of NOIs, believing I'd be selected.

So doing French, or waiting 2 years for Masters is not an option really (well not for me).

Twiddle thumbs and wait for NOI. But get your docs ready for the OINP Application as there might be tight timelines.
