Spouse is on visitor record (expiring in March), we are planning to leave Canada since I haven't been able to find a job which satisfies owp requirements. Since lease only expires in May, planning to apply for visitor record extension and ask for extension at least till then.
Spoke to an immigration lawyer who said we can apply for extension even on the day before the record expires, but now am seeing that if a rejection comes, we have to leave canada at the end of authorized stay (if we apply in March, then spouse will be out of status after rejection).
How can we handle this? Should we apply for extension at 30 day window and hope for the best?
also, is it ok if we tell ircc that we would like to stay till may as our lease cannot be broken?

Yes, we are looking to find someone, but what happens if we can't find someone? Our landlord said it's either stay till the end or transfer the lease. That's what we're worried about - should we apply for an extension now asking for time atleast till May, or wait to file the extension till the day before spouse's visitor record expires?

You can apply for the extension (preferably couple days before the expiration date - so ideally you get implied status after expiration date while you wait for the result of the extension). In case you didn't get it, I guess if that happens and you can't find someone to takeover, then you got no choice but to talk to the landlord again that you need an early termination. Maybe the landlord would accept at that time.
