Hi there,

I am a PR and have spend 1 year in Canada.
I still should live in Canada for another year to fulfil my minimum 730 days requirement.
This means I can live outside Canada 3 years.
Recently I received a job offer from the US company and I can work with them for 3 years and I have only about 20 days of vacation each year to spend in Canada.

I read somewhere that I should spend at least 6 months in Canada every year in order not to face any problems with keeping my PR status, etc.

I would like to know if this is true or I can take the job and spend a couple of years abroad without being afraid to lose my PR status.

Please advice.

Thank you in advance.

Hi Michael,

730 out of 5 yrs is MANDATORY to retain your PR status in Canada. I am afraid you will lose your PR status if you do not spend another full year in Canada.

The 6m/yr stay in Canada does not make any sense if you are physically present in Canada or 2yr.

Hi Michael, Congratulations for a job offer!. :D
If you take up that new job in USA you can stay only 80 days or less during the next 4 years and therefore you will loose your PR status. So I suggest if possible, to continue in the job for 3 years or little less, to meet your PR obligation.

The 6 months a year rule was the old residency requirement for PR's. It was changed in 2002 or 2003 to 730 days in 5 years and still is. If anybody tells you 6 months a year, tell them that their information is outdated and they can look it up on the CIC website if they don't believe you.
