Hi,

I had applied for my PR and open work permit under Live In Caregiver program. I have received my open work permit last year in May 2013 still awaiting my PR. I have a dependent daughter (minor 17 yrs of age) who is staying with my brother back in my country. Recently a letter was received by her requesting to send filled in Application form, along with Additional dependents and background declaration forms. Additionally they have requested birth certificate, passport and document to prove relationship with myself.

That being said, my daughter does not want to come to Canada right now. I am not sure how do I need to proceed with my application.

Questions:

1. Can I update my application and mention her as a non-accompanying dependent?
2. Would this impact my own application for PR?
3. What do I need to inform CIC and how?
4. How do I make sure that I could still sponsor my daughter in the future and that the doors do not close for her permanently?

I humbly request any help and guidance to move forward.

Thanking you for you help in advance.

1. Yes
2. No
3. Write a letter to your visa office and ask to change the status of your daughter from accompanying to non-accompanying.
4. As long as you have incuded her as non-accompanying and she has had her medicals, you would be able to sponsor her as long as she is considered a dependent child.

Currently, the cut-off age for a dependent child is age 22. However, children who are married or in common law partnerships are not considered dependent and children who are studying and financially dependent on their parents since before the age of 22 are considered dependent until they complete their studies.

However, immigration has been considering lowering the cut-off age to 18 or 19 and disallowing overage students. If they do that, because she is already 17, you would very soon be in the situation that you can not sponsor her, even though you have included her as non accompanying.

What you could consider instead is that you do not change her status to non-accompanying but leave her as accompanying. She will get her PR visa and she can make a quick trip to Canada to land as a PR and to visit you. After landing as a PR, she would be allowed to be outside Canada for up to 3 years without a problem so she will have those 3 years to make her final decision.

Thank you Leon for your guidance.

The letter that has been sent to her is from Canada Immigration office in my home country. When you suggested writing a letter to my Visa office did you mean as a response to this request write a letter to CIC in my home country?

Warm Regards.

If your file is being processed in a different visa office than hers, I suggest you send the letter to both of them.
