I applied for my study permit extension on September 2022 which was about to expire on December 2022. So far, there’s no update on the SP extension application. Meanwhile I have completed my graduation on January 2023.
I am planning to apply for PGWP now. My questions are:
1) Can I apply my PGWP now while the SP extension application is still in progress?
2) If I apply PGWP while on maintained SP status, am I eligible to start working full-time before receiving the PGWP?
You are eligible to submit a PGWP application on maintained status, but it will make you lose the ability to work full-time while waiting on the outcome of your PGWP. You can only work full-time once your PGWP is approved in that case. I'm in a similar situation, as I was advised by an immigration advisor at school to wait until the SP extension results and then apply. However, I was advised not to wait until more than 90 days from the date of completion of my program, as it would invalidate my status as a student.
If I'm waiting on a response to the study permit extension application, and my studies are completed, but after the expiry of my existing study permit, I understand my status will be "maintained," and making a PGWP application on maintained status will not allow me to continue being eligible to work.
However, is it breaking any IRCC guidelines if I wait to get the results of the study permit extension application after the completion of my program AND the expiry of my existing study permit? I do not have any other pending academic requirements than getting my thesis approval which will be soon submitted. Do I have to register for the upcoming semester if I submit an extension? Or is it okay not to register for the next term while requesting a "bridging" study permit extension (as they mention many university guidelines for immigration)?
If I apply for a PGWP application after getting the outcome of a study extension application (however, after the expiry of my existing study permit AND completion of my studies), will it allow me to continue being eligible to work?
